  • I wonder that as well. I find it hard to believe that they would order mum to return just to take the children from her and put her back on the first plane out of here! You would hope that the OP's solicitor had done his homework on this. It is quite worrying that he/she doesn't seem to have done it, however.

    OP - is there provision for Social Services intervention within the Order if she returns?

    Thank-you. I've been in touch with social services and they are very keen to be involved when she returns. However, we would have to see where she is living before social services can get involved (as they only take on a case if you are resident in the area)

    It is the high court who have ordered her return asap. Of course I would not like her to be back in the UK without a home - that is why I am trying my best to obtain some information so I can provide information to the court about how she can find a home and support herself financially. I am trying my best to ensure she does not arrive on a plane without a home.

    (she has clothes, furniture etc in storage (I am paying for this) from when she left our family home unexpectedly - I have never considered getting rid of her things)

    It came out in the court case that the children were at risk from their mother. I have attempted to find the children for 2 years. The courts in this country have been trying to find the children for 2 years. Each time she is located, she then disappears again.

    I would have loved to have been in the childrens lives in the past 2 years, but this has not been possible as all attempts to make contact have been blocked.

    I have not heard one word from her since the day she left.

    When you say it came out in the court case who exactly said it?

    I don't understand why the police/social services in her own country have not taken them if they are deemed at risk.

    Since this is primarily a benefits board then the following benefits are what your ex wife might be entitled to:

    Income Support (as the children are under 5 years of age)
    If awarded this then your ex would be eligible for Housing Benefit and Council Tax Benefit. Your ex would receive, as a maximum, the local housing allowance for a 2 bedroomed privately rented accommodation - you can look up the local housing allowance on the council website.

    To be eligible for Income Support I believe that your ex would need to be in receipt of Child Benefit.

    If Child Benefit was awarded and then Income Support, HB and CTB then she could also claim Child Tax Credits.

    In the event of your difficulties because of the unusual circumstances and without entering into a discussion into the rights and wrongs of this difficult situation then..........

    I would telephone the Child Benefit line on 0845 302 1444 and explain the situation to see if your ex could claim this.

    Based on the information they gave I would then telephone Income Support on 0800 0556688 and explain the situation to them and see if your ex could claim this.

    To be honest I am not certain that anyone on this forum will know whether these benefits would be awarded so your best course is to go to the 'horse's mouth' so to speak.

    The chances are when the mother and children do return they could be placed in a bed & breakfast which could further add to their distress at being forced back.

    Is it not possible for you to find and secure a home for them to return back to? You have access to her belongings and could set the home up for them, surely that would be less traumatising for all 3 of them.

    Whilst this is an admirable thought, from what the OP has been saying I do not think he is in a financial situation to be doing this.

    The OP needs to show that the ex would be entitled to benefits to support her and the children or could be supported financially by him (not possible from what has been said)

    If the OP could be assured that she would receive benefits at some time in the near future then this would prevent an appeal and secure their future.

    I am sure that the OP would be willing to do all he can temporarily and your point about B&B accommodation being unsuitable is a good one (sorry, that sounds very condescending! :))

    THANK-YOU for all your information. This is just the details that I came on this forum to find out about. The children have previously received child benefit/tax credits, so I am sure it would not be difficult for her to re-start these .... but I will not know until I telephone the numbers you provided. Thank-you for your informative response ... it's good to know the 'order' these things are dealt with, so I could write a flow chart of actions.
