Parking eye fine at Southampton Town Quay

Hi there,

I'm wondering if anyone can help me or give me some advice please?

Last weekend I parked at Southampton Town Quay car park to watch the fireworks. I arrived at the car park and paid for 3 hours parking.

This morning I received a letter from "Parking eye" informing me that I have to pay a £100 fine for parking in their car park for 1hr and 44 minutes.

I definitely paid to park, perhaps I entered my car registration number wrong because it was dark in the car park but I still paid for the car parking.

I really don't know what to do because £100 is alot of money which I don't really have at the moment.

I'm reading that the law has changed so they can basically they will go after you for the fines.

I'm absolutely sickened. Can someone please give me some advice please.

  • Ignore it, it is a fake invoice. Totally unenforceable: the demand is unlawful.

    They will go after you with their empty threat letters, as you paid your dues to them to park, you owe them nothing.
    take a look at the letter chain sticky at the top to see whats coming next and play snap as the letters roll in.

    Alternativly you can appeal to popla which will cost the parking company some money, from which the judgement will be binding on the parking company but not you.

    and another opotion would be to tell them to stop sending you threating letters, as you paid, and owe nothing - and if they dont stop you may consider taking action for them under the protection from harrasment act.

    One more thing as the threat letters roll in, post them on here, some parking compnaies have been sending out letters that have got them in trouble and banned from accessing the DVLA database, if pakring eye fall foul of the rules a DVLA ban would pretty much stop them in their tracks.

    No they didn't. I bet they did not use the word "fine". That's just your misplaced interpretation on what is, in fact, a simply unenforceable request for your money - a request you can decline either by ignoring it, or by telling PE where to stuff it.

    The change in the law alters nothing in this regard. They were free to pursue the driver before. Now they can pursue the registered keeper if they cannot find out who the driver was. Big deal (not). It doesn't make their request for money any more legitimate.

    Ah, Parking Eye !!!! Ignore them. They cover my local Aldi car park and I regularly break their "rules" and then send them an email baiting them. Strangely they don't seem keen to send me an invoice - I suspect it's because they know I know that it is unenforceable :rotfl:

    Thanks for the replies everyone. It's made me a feel a bit more confident about not paying although I would hate them to go after me cause I really don't have money to go to court or pay fines or anything.

    I got an extra slip with my letter informing me about the Protection of Freedom Act 2012 which was passed in October. How does this effect me and ParkingEye?

  • Court is the last of your worries. They would have to pay for it, then they'd have to satisfy the judge that they are seeking landowner losses and not a de facto penalty - and this is their stumbling block, hence the reason they won't try court.

    Protection fo Freedoms doesn't amend the legal situation, but if I were you I'd drop them a line telling them you deny their charge as the amount exceeds landowner losses. They'll either accept it or they'll reject it, if they reject it they will need to produce a POPLA reference number. You then make the same grievance to POPLA, that will cost ParkingEye £32, and the result is irrelevant to you! :)

    You are the second person today to say they have read and thought this!

    Please tell us where you read this misleading guff. And ignore the fake PCN.

    As others have said, it really is easy to ignore this scam. IT IS NOT A FINE, WHY WOULD YOU THINK IT'S A FINE?

    3. Watch this Watchdog clip below. With the 'new law' the only thing that's changed since this youtube clip is that they no longer need to know who was driving and - if they have reasonable cause - they 'can' send the letters to the owner/keeper - who 'can' still ignore them!:

    You asked that already, and I answered. Maybe you didn't realise I was talking about the POFA. So, here it is again:

  • Thanks for all your reassuring comments on here, i also went to watch the fireworks because we couldnt afford the tickets,i thought my littluns could still see the fireworks if we parked in town quay, where in previous years ive parked after 6pm without a need to pay, whilst driving in i did not see the signs, particularly as there were lots of people about and i like to concentrate when im driving not look for signs to read.
    Yesterday i received the same letter, with a nice photo of my registration, and was horrified at the charge requested.

    i assumed as it was late i would not need a ticket, we were there maybe an hour and a half, once parked we were blocked in by others also looking to see the fireworks, and a large proportion of the time spent in the car park was waiting to get out.

    I have been worrying about how i will afford the charge, but comments on here have taken the weight off my shoulders, im new to moneysavingexpert, but am already grateful for the knowledge provided.

    I shall ignore anything from Parking Eye from here on.
