Good evening all,

Further to my original post, see below, I have decided to do an email appeal to Parking Eye, for a few reasons

- Peace of mind
- Fighting an unjust action
- If went to court would look better on me
- it will costs them

So, because I didn't do anything wrong (note the signs say no return within 2 hours - I didn't break that rule) Surely its up to them to prove I am lying.

I plan to email them

"Parking Eye

I received parking charge notice number xzy. I will not be paying this because I used the car park on two separate occasions, and did not return within the no return time of two hours. I have attached a redacted (bank balance) ATM receipt for the later visit date showing the date of the alleged incident.

I can confirm if you reject this appeal I will certainly be appealing to POPLA

Name Surname"

Anybody got any advice or should I say it differently.

I guess they will just deny it, in your opinion what would POPLA have to say?

Original post

Hello,

Please could somebody advise.

Please note this was mid October 2012 and I have read the law is different now, so I am worried about ignoring this

I have received a ticket from Parking eye, they stated I have exceeded the time allowed in a car park, its a local one around the corner from me. Its a free car park with doctors, nursery, video store and small supermarket. I think there is a sign on the way in that may tell you how long you can stay for.

Upon checking my diary I remember that I went and parked there after work for about ten minutes to use a shop, at about 16:00, then went in again at bout 20:00 to use the same shop for some red bull for a long journey.

Their cameras have picked up my entry at 16:00x and me exit at about 20:10 and come to the conclusion I was there for the duration. thus exceeding the 2 hour max stay.

they have sent me a "Parking charge notice" asking for £100, or £60 if paid sooner.

Is it upon me to prove I was on there on two separate occasions? It is a lot of money to pay and I really dont trust I would get a fair hearing if I appealed.

What do I do?

Best wishes.

I received parking charge notice number xzy. The ticket was given in error, I used the car park on two separate occasions, and did not return within the no return time of two hours. I can prove my whereabouts with my vehicle so I require that you cancel this invoice to me.

If you intend to refuse this, I am prepared to go to Popla and require a final answer from you and the paperwork to raise an appeal to them.

    maybe something like that?
Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?

IMHO this is good for two reasons. You give a good reason for an appeal to succeed. You tell them if your appeal is rejected you will appeal to POPLA. This means they know it will cost them if they reject your appeal. Thats if they actually read your letter of appeal!

  • Thank you for your swift replies. just a couple of following points and one new point from me

    1) Should I not bother with the ATM receipt?

    2) My car is 7 years old and in a sorry state, they would probably not believe this "I can prove my whereabouts with my vehicle so I require that you cancel this invoice to me." I presume you mean a tracker device

    3) A new throught - might give them something to consider.

The car park has only one entry/exit road (barely two lanes) the camera clearly covers both the entry and exit of vehicle (hence the photo of my car entering and leaving). As there is no possible way a vehicle could leave the carpark without being visible to the camera (vertical take off aside) could I threaten to complain to the BPA that they appear to be using only select images, to give the impression that vehicles have stayed longer than they actually have? thus making false allegations?

Should I demand to know why they did not pick up my car leaving the first visit, and re entering the second time?

From what I have read here appealing or rather complaining to the BPA would not be worth the trouble. Its best to make any complaints, if you have any, to bodies with real authority like the DVLA or OFT etc. In my humble opinion if you wish to do anything then appeal to the PPC, they will reject it even though you could prove your case, then appeal to POPLA and then sit back and relax with the knowledge you have cost that PPC money and they haven't got any of yours.

No point sending them anything like an atm receipt, what I mean by you can prove your whereabouts is that you have a couple of witnesses who will say that you were with them, saw you etc There is little point contacting the BPA, this is what they will send in response.
Thank you for your letter received 00/08/2012 which refers to a allegations made by you against Parking as Ticketing Limited .We have given your case the reference PT 00/00 and would ask that you use this on any future correspondence.

I can confirm that PT 00/00 is a Member of the BPA’s Approved Operator Scheme (AOS) which was developed to bring a degree of regulation to an industry without primary legislation. We are not a regularity authority though and as such we cannot handle specific appeals against parking tickets or other enforcement actions taken by our members but we can take actions where we believe they non-compliant to our Code of Practice. This can be reviewed on our website- www.britishparking.co.uk.

If an operator is found to be non-compliant of the Code, they would be subject to our Sanctions Scheme, where Operators who are non-compliant with the Code can expect to receive a number of penalty points depending on the severity of the offence. As with driving offences, once an operator’s ‘licence’ has reached twelve points in any given 12-month period, then they are likely to be faced with suspension or expulsion.

Although we sympathise with your predicament we have no power to get an operator to cancel or refund any parking enforcement charges. With this said, I regret to inform you that on the evidence you have supplied to us, we do not believe our Memberhas acted in non-compliance of the Code of Practice in this instance as the allegations Therefore, they are compliant with the code of practice.

I appreciate that this response might not be what you hoped for from me but please rest assured that we take all complaints about Members seriously and that I have looked closely at the points you raised. If you have any additional information pertaining to your case which you feel may relate to non-compliance of the Code, please forward this to us. However, if we feel that the operator is acting within our recommendations, we may not be in a position to enter into further correspondence with you.

Thank you for bringing this matter to our attention and endeavouring to assist us in our efforts to drive up standards in the parking industry.

Would it be worth letting the supermarket know about this? I would guess 70% of car park users here are for the supermarket. This is my latest draft and have added in the supermarkets customer service team in the same email.

p.s sorry for asking so many questions, just want to get this right

    Parking Eye,

I received parking charge notice number xzy. The ticket was given in error, I used the car park on two separate occasions (Both to use the xxxxxx supermarket), and did not return within the no return time of two hours.

I have a witness that can vouch for the whereabouts of myself and the vehicle in question for between approximately 16:30 and 19:00

If you intend to refuse this, I am prepared to go to Popla and require a final answer from you and the paperwork to raise an appeal to them.

    xxxxxxxx retail Team,

Please refer to the above, I just wanted to bring it to you attention, as I do not
appreciate being sent parking charge notices asking for £100 for using your supermarket twice of an evening (even though I did not break any of the (free) car park terms of use). I appreciate this is not your fault but would appreciate it if you could investigate the matter further, to avoid errors like this happening again.

Why bother when all you have to do is ignore them like I did. You are probably winding yourself up for no reason, life can be hard enough without increasing your stress level.

I am not stressed, but like peace of mind.

I just want to make them aware people will not stand for this first in last out style scam, and make them pay some money for being immoral scum with regards this first in last out scam, that some people might get taken in by and pay.

Final draft, will not bother with CC supermarket. Am just going to get to the point:

Thanks to all that have advised.

If you really want them to go to popla or not ? just say this

    Without Prejudice

    Dear Parking Eye

I will not be paying your penalty invoice unless hell freezes over first, so cut the carp I know your invoice has the same merit as a Nigerian King asking to put millions in my bank account. I suggest that you either drop your demands or send me the popla form so I can do a real appeal there, this will cost you £32.40 and is binding on you but not me.

    So your choices are thus

    1) drop the demand
    2) go to popla at a cost of £32.40
    3) long walk off a short pier

Your choice but you'll never get money off me.

    Love and kisses
