Look, just go straight to POPLA (make sure to read up on what are acceptable appeals and make sure to use one that fits). Costs Parking Spy £32.50, but costs you nothing.

He can't as parking eye must issue the code to go to popla, so it means you must exhaust their sham appeal first.

They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?

He can't go straight to POPLA - he needs Parking Eye to reject his appeal first and supply the POPLA code.
All aboard the Gus Bus !
  • Exactly,

I need the code first. Hence I sent an email appeal.

Not sure exactly how POPLA decide cases, I will apply under

The vehicle was not improperly parked: e.g. that the vehicle was not parked where stated on the parking charge notice; that you believe you were still within the time you paid for; that the voucher was clearly displayed or that the conditions were not properly signed.

But its not like I have any evidence other than an ATM receipt. Is it up to me to prove innocence or P/E to prove guilt?

Well peaved at this actually. in my opinion blatant first in last out photo fixing and its wrong.

    Dear Parking Question Chap

We have carefully considered your appeal and have decided to uphold the parking ticket as it was issued correctly in line with the display terms and conditions of that car-park.

    Please pay us more money

    Kind Regards

You do not need evidence for Parking Eye - but save that receipt for POPLA (say you've 'just found it' when you get to the POPLA stage!).

And I would seriously consider making the email MUCH more of a complaint and to copy in the CEO of the Supermarket (Head Office top banana not the local Store Manager). If you do then put the email subject line as summat like:

Complaint about parking ticket - ANPR scam in xxxx car park.

Then the retailer will know what it's about, just copy them in and make your email much more of a complaint about the fix. You made a lot of sense with your final line (my bold above) this is a fix and you are being too polite, calling it a mistake.

Think about it, you were a customer and this is NOT ON!!

If you've already emailed PE then forward it to the CEO of the Supermarket with a covering COMPLAINT.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Forget the receipt (for now, but don't lose it). You don't have to prove anything. PE would have to prove that you were continually parked for the duration they claimed. They cannot.

You should add to your complaint to PE that their camera systems do not appear to be operating correctly as they seem to have omitted some of your car's movements. This is a deliberate and well-known trick employed by many of the parking companies, and needs to be exposed as such.

Ask for them to include the landowner contract in their reply. Point out you are aware their contract was shown not to enable court action in Parking Eye v Somerfield
