  • Well thanks to the template here we were delayed by 3 and a half hours to Tenerife in July this year. Easyjet just credited my credit card for 1600 Euros. 400 for each traveller.Only sent the letter 4 weeks ago then a follow up e mail to the ceo 2 weeks later.
  • Hi all, can anyone help me? It's a long shot but my flight was delayed for around 6 hours, from Gatwick to Bourgas on 20th June 2008. Only trouble is it was with first choice airlines which have now amalgamated with Thomson, and flightstats aren't saying the flight was delayed and I KNOW it was. Can only find a bank statement that says we made a payment to 'First choice airlines' in March 2008, no other proof I was on that flight, am I fighting a losing battle? Is there anywhere else I could look? I would really appreciate any help in this matter! Thanks in advance!
  • I think if you are willing, you should contact Blueway Limited.com - they helped me as far as they could. They are a no win no fee company, they will take a 20% cut of your payout, which some would be unhappy about - but my case was messy so I felt that was easier than attempting to battle it out myself.

    We were delayed 6 hours in 2005 (The UK do not deal with claims this old but Spain do) by BMI Baby, (who no longer exist!). I didn't get a pay out in the end as my flight was delayed at the UK end - but this company did all the fighting, kept in regular contact with me and charged me nothing.....worth a try if you are struggling! Flightsats also came back with our flight was only delayed by 15mins, which was untrue and Bluewater officially confirmed I was telling the truth. My documentary evidence was simply an copy of an email with flight times and number on - so don't worry about your evidence. Good luck.

    Everyone please read through the threads there are various firms who offer no win no fee. There is one particular firm (not the one quoted here) who are doing by far the vast majority of claims. Do your own research then make your own decision.

    As with any business you are considering appointing, do read the terms and conditions very carefully. If there is something you don't understand, raise it before you commit.

    If I was being picky, I'd say some of the stuff on their website looks a bit careless:

    "The outcome of a recent court case means we are now able to claim for flight delays dating back to February 2005."

    "Had a flight delay dating back since February 2005? Don’t delay, contact Blueway today."

    "we take just 20% of any monies reclaimed for you which is far cheaper than any of our competitors - whilst you will receive the remaining 80%" No mention of VAT

    "we take just 20% (plus VAT) of any monies reclaimed ... whilst you will receive the remaining 80%. "
    There won't be 80% remaining if you pay 20% + VAT
  • My family and I were on holiday in Turkey in 2006 with First Choice when an idiot decided to drive his car into a Scottish airport. This meant every airport beefed up security. Our return flight to Birmingham was delayed by over 11 hours - we were left at our hotel with our luggage in reception with no information or help. There were at least two further flights to Birmingham that left our hotel on time with no problems before we finally left the hotel lobby we had been sleeping in. The holiday company blamed the airport because of the increased security. Watching Martin Lewis tonight about holiday delays made me wonder, does this mean we have a claim for compensation (unfortunately we missed most of the programme and only saw the end so I don;t know what else was said)?:question::question::question::question:

    Where do I go from here :(

    Amongst lots of other things you are out of time to claim.
  • Some advice would be appreciated, I made a claim to Thomas Cook for an 11 hour flight delay my family and I had in 2012 from Turkey total compensation sought €2800.
    The initial claim was rejected by TC stating 'extraordinary circumstances' and specifically on the grounds of a technical nature. TC quoted in their response :
    "The captain found static inverter fault, new part was required"

    I escalated to the CAA who upheld my claim and informed TC that my claim was valid I then gave TC a month or so to get back to me but I heard nothing. Therefore I decided to contact TC via the link on their website and received a response saying they were investigating my claim.

    Last week [Jan2015] I received an email from TC requesting proof of travel on the delayed flight and specifically I should send copies of my flight boarding cards or ticket or invoice.
    Luckily I had copies of the 'e ticket' and invoice which I forwarded to TC. Stupidly thinking that TC may actually pay the compensation I felt quite pleased.

    Yesterday I received an 'e mail' from TC saying that they have re-assessed my case and the delay was due to
    " a manufacturing defect on a part replaced on the aircraft"

    TC carried on to say that technical faults due manufacturers defects on parts are classed as "extraordinary circumstances" and therefore they are unable to offer compensation. TYPICAL!
    Why did TC not quote this reason in the original correspondance, or is this the latest tactic TC are using to "con" claimants out of any compensation due ???

    Apologies for the long winded thread but I believe TC are trying to fob me off , the questions i would like assistance with are as follows:

    1. Do I write back to TC disputing their findings and ask for clarification as to why i wasn't told this in the first place and whether the manufacturers defective part was the original part on the aircraft or the replacement part, if it was the latter then i believe i still have a case.
    2. Do I write to the CAA again regarding TC's response and ask for them to look into it.
    3. Do I go down the legal route and get advice

    Any help would be appreciated as I believe TC are minipulating the facts to get out of paying compensation
