Perhaps someone who is speaking to the media could mention that it has come to light that Neil & Caroline Alvey who run the NHCo previously owned a company called GIFT BASKETS GALORE LIMITED which was originally run from a shop in Stalham then the trading address was changed to a residential property in Caister in March 2009 before the company was dissolved in November 2009. A local journalist may be able to dig up a bit more info on that business & find out whether or not there was a lot of customers left unhappy & out of pocket then too.

Makes me wonder if the three year gap between companies was due to family illness as he claimed, or because he was barred from acting as a director?

Just speculating Neil, in case the thread Police are watching. :rotfl:

I had a reply from Citizens Advice, apologies if someone has posted before:

    Dear Mrs X

Thank you for your enquiry to the Citizens Advice consumer service dated 21-Dec-2012. Your reference number for this case is _______ and should be quoted in all further correspondence regarding this case.

From your email we understand that you placed an order for hampers to be delivered. This order was not completed and you are looking for advice on your rights. Based on the information you have provided the key legal points in response to your enquiry are:

Firstly, we would like to explain that although there is no excuse for poor customer service, there is no legislation governing how a trader should treat a consumer. As such, if a trader or anyone else refuses to offer an apology freely, there is no authority that can order that trader/person to provide one.

UK law suggests that if you can demonstrate that the trader has failed to comply with any agreement you both reached during pre-contractual negotiations (discussions held between yourself and trader before you completed the purchase); you may hold the trader in ‘breach of contract’ and pursue them for a suitable form of redress.

What you may seek is dependent on the severity of the breach. To clarify, if the breach is serious, you may seek to end the contract and claim a full refund of any monies already paid; whereas if the breach is minor, it may be more appropriate to claim a partial refund that reflects the nature of the problem.

Any other costs you incur as a direct result of the breach of contract are known as ‘consequential losses’ and you may ask to be reimbursed for these costs. It is important that you take all reasonable steps to keep such costs to a minimum, and you may need to provide some evidence of what the losses are and why you believe the trader is responsible.

Ultimately only a civil court can decide what if anything you are entitled to and order the trader to provide that redress. A civil court would expect any claimant to be able to demonstrate that the consequential losses suffered were, foreseeable and you can also justify and mitigate (make less severe) those losses.

Furthermore, you would be expected to demonstrate that taking civil court action was the last course of action available to you in order to resolve your civil dispute once and for all.

At this stage we would advise you should take a more formal approach and write to the trader. The letter should outline any relevant events regarding this issue and make it clear what you expect from the trader and why. It should also give the trader a reasonable time to resolve the matter.

Template letters can be found at: http://www.adviceguide.org.uk/england/consumer_e/consumer_taking_action_e/consumer_making_a_complaint_e/consumer_sample_letters_e/list_of_sample_letters.htm (if the link does not work when you click it, please copy and paste it into your browser address bar). Whilst there is not a letter specific to your situation, you could use the templates as a guide to layout and what to include in your letter.

We would also suggest that any letter is sent by recorded delivery and that you keep a copy - this may help you prove that you have contacted the trader and tried to resolve the matter amicably, and also you can use the 'Recorded Signed For' label the post office will supply you with to confirm that the trader has received the letter.

In addition, you could also try to obtain a refund from PayPal. To clarify, you may be able to seek a refund from PayPal depending on the terms and conditions of their service. You should submit your claim in writing to the PayPal, asking that the matter is resolved in a timely manner. You should be aware that PayPal may not have any legal obligation to comply with such a request, but some consumers affected by similar events have achieved a successful outcome by approaching PayPal in the past.

If you require any further civil advice or information about this case, please do not hesitate to contact the Citizens Advice consumer service by return email or on 08454 04 05 06 quoting the case reference number.

    Thank you for your enquiry.
