    Hi All,
    New to the site so all help appreciated. Have closed my account and opened new one elsewhere,all ok with new bank, however am overdrawn and also have loan with old bank.
    If I claim back all charges and win, will old bank just take money off all that I owe them? Am currently on DMP with CCCS.

    All of the banks are going to offer less than you are due no matter your banking status, thats the name of the game. Then it depends if you can carry on and fight for the rest.

    Its more than likely they will reduce the amount you owe but I'll pop your post into the thread discussing this.

    Thanks for such a quick reply, further to your answer, lets assume that bank owes me £4k in charges, surely theyre going to fight and offer less due to the ammount I owe them which is obviously more than the £4k they owe me?
  • Hi can anyone tell me if I can claim back from old credit card accounts which have been closed due to been taken because of an IVA.

    I was thinking a similar thing. I have had bad debts in the past and have been paying a reduced amount interest free on various debts (all debts have been paid off with a settlement figure) - can I claim back the charges etc. or not? :confused: Any advice would be great :T .

    Can anyone help!

    My C1 debt is with a Debt Collector, now I've not actually paid the charges I'm claiming back but I obviously want them removed and the balance to be adjusted accordingly.

    So, what should I put in my letter? Should I say that I want them to remove the £200 charges from my account and advise the DCA accordingly?

    I think if I was in your position I would maybe write to them and say they owe you the £200 so to remove them/credit your account with this amount to bring down the balance you owe :confused:

    I am currently in an IVA including HSBC who i banked with for 10 years but who i owe £8000 to in the iva. Can i still claim back my charges from them even though they have frozen my account? In total they have charged me nearly £3000 (which really helped my situation hence the IVA!!) so can i still claim this back or will they just reduce it from the amount i owe.

    Please can someone help me before i send the info in.

    Thanks for the reply and after looking at the other threads will contact cccs and inform them of my plans to try and claim back the charges. one other thing, I have new bank a/c basic type, no o/d /chequebook facilities which suits me fine, however my debit cardfrom them is Visa Electron which basically is limited in its uses as not all retail/petrol/hotels outlets accept them. My bank advises to open current a/c but I dont think I will get one as I am on a DMP and surely the bank will find this if I apply for a current a/c. Are there any banks that will give you a normal debit card as per the one you get with a current a/c or one that is more accepted than Electron as its embarrassing at times finding out that when you go to pay the shop doesnt take electron and that you have to look/ask all the time before you go shopping, petrol etc etc etc.

    i reclaimed bank charges with Bank of Scotland and got a letter back this morning saying they will refund the full £1100 due. They say money will go back into account within the next 14 days. Problem is I instructed a company to do this for me and they are charging 25% which is fair enough. My problem though is that this bank account has not been used since 2003, since we joined a debt management company, currently repaying back the £2000 which is still on it. Obviously BOS have agreed to this monthly repayment plan.. does the money have to go back to this account? i am worried that if it does then I wont be able to afford to pay back company which helped me get this money in the first place. I have been told that majority of banks are sending cheques out. Should I call BOS to see if they can do this with me?
