Here's an update on my situation.
Upon finding my car ticketed, I removed ticket and stuck it to a lampost next to my car and left it unread.
I received an email from parking nazis this morning, "did you know you have a parking ticket? This will not simply go away you know. (how patronising?!?) It will simply add to your costs" etc.
So now I am being harrassed. It will only be a matter of time before they come to my department to find me in person.
We all had to sign a form (agreement/contract) to collect our parking permits. I signed, I pay out of my salary before I get my pay, on the day concerned I swiped into car park to find no spaces, so found somewhere to leave the car so I could get into work. Does the fact I signed something change anything regarding laws/rights/ chances of going to court?0 -
So you are effectively paying for a service which they are not providing to you?

Rather odd as it has nothing to with work. At one trust they put on their website failure to pay may result in discipline. After several emails form lots of different people they removed it. Data protection all that kind of stuffThe word about the scammers is spreading like marmite here in the westcountry.

Yep I'm emails at my work address from Balfour Beatty Workplace. Can't run or hide.
She even referred to my ticket as 'a fixed penalty' ! I have saved&printed this email but have not replied.
As for signing for our permit, I'm pretty sure there'll be a clause / agreement in there somewhere but I don't have a copyI'm also not in a union.

Who is saying you have to run or hide? Certainly don't reply or pay. Ignore and save them into a folder - a bit like deleting phishing emails, the only difference being don't delete, but instead save them all as evidence of this harassment.
Get other colleagues to get your union aware of the scam of PPCs, or send a completely anonymous complaint (no attachments, just info by snail mail) to the Union to get them to sit up and take notice what's happening. This isn't a penalty but the fact the email says it is shows exactly why it would never win in Court.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It would never win in court despite the fact I've probably agreed to their policy somewhere along the line? And not agreed because I wanted to but because I have no choice!!! There is no alternate parking. Where can I find the relevant laws&legislation for myself?

They have already emailed me so I'm not worried about this. Like I said they will probably hunt me down in person. The email quoted my name, department, extension number and permit number!0

There isn't any law or legislation except for the Protection of Freedoms Act which just abnned clamping and brought in the POPLA appeals service for tickets issued in E&W since 1st October.
The reason there's no law is because this is about an alleged trepass which is just a civil tort, to be heard in Court if not resolved. The PPC will reckon there's a contract but there isn't, not between you and them as they are a third party and because this one is about trespass, not contract. They may have a contract with the hospital but you are not party to that and the PPC themselves cannot make a valid claim for trespass, that would 'stick'. What exactly do you think that the PPC are going to do? They can do nothing because clamping and towing are banned. Possibly, potentially, the hospital themselves could try to ban you from parking there but that would really shoot them in the foot wouldn't it?! You already pay for the service of parking and they need you to be there to work so the problem is surely the LACK of spaces?!
I am getting a little fed up with this long and rambling thread (sorry) but we have already answered all this and your case is no different than any other fake PCN. Look how many cases we have on the go on this forum right now, all of whom are told the same thing, many of whom have the added complication of the car park being their workplace or their residence/block of flats. Just like on this thread. No different.
I have already said that the hospital is the only entity to be wary of because some hospitals have been known to try a small claim over these fake PCNs. But the PPC would lose if they tried, because they don't own the land and cannot have suffered any loss by your 'trespass' into a non-authorised place to park. The hospital could only succeed if they can prove LOSS. Can't see that winning either as you pay to park and didn't damage anything!
Just ignore the fake PCN and any letters/emails from the PPC, just like loads of other nurses and doctors do all over the Country. Sit up and take notice ONLY if the Hospital actually get involved (but do not offer to pay the fake PCN, object to it strongly if it's raised as a disciplinary matter and say you will take it seriously if the PPC take you to Court - do not suggest that the hospital themselves do!).

It's rather sad that health workers have to deal with all this crap over parking as well as some of the other difficult things they have to deal with in their work time.
I would wager the CEO has a reserved space!0
