Today I have recieved correspondance from Employment Tribunals....it is a NOTICE OF CLAIM...NOTICE OF CASE MANAEMENT DISCUSSION BY TELEPHONE on 27th February at 14.15pm

Reading it I think the Respondent has until 28th January to respond to it, but it also mentions coming to a amicable conclusion prior to case?

I don't really understand all the wording etc., ..help please???

    Okay,

first, the employer has to file a response. You will get a copy of that before the case management discussion takes place.

secondly, you mentioned before that you intended to get advice from your local law centre? Have you done that yet?

the reason I ask is because you really do need to action the questionnaire procedure as soon as possible as you only have 28 days from lodging the ET1, so the clock is ticking. You need assistance to do that.

The letter should tell you what the purpose of the telephone case management discussion is. I am guessing that it is for the parties to say how many witnesses are likely to be called, how many days the hearing is likely to last, whether there are any days that the parties cannot attend (because of holidays etc). But I am just guessing which really is not helpful. You need to read the letter and/or take it to CAB or the law centre you spoke of earlier, and get face to face advice.

Have you had any contact from ACAS? You should be allocated to a concilliation officer, and any settlement negotiations will be conducted through him/her. ACAS will also have received a copy of the letter, so you should ring and ask to speak to your concilliation officer (do not be fobbed off by the call centre person who answers the phone as they are not legally trained, you need to speak to the person allocated to your case).

Now that the papers have been lodged with the tribunal, there is a limit to what we can do to help you from here, as you really need someone who can sit down with you and go through the paperwork with you.

Just a thought - did you check whether your house insurance includes legal cover? This will normally include cover for tribunal proceedings. I know you consulted your husband's advisers through his employment, but it is worth checking with your insurer as they should pass you to an independent solicitor.

Even if you haven't heard from ACAS yet, you can still phone them and give them your case number, and ask to speak to the concilliation officer allocated to your case, although you'd be better seeing an adviser for a face to face chat as you will probably want to get a representative on board.
