Rather than simply clicking the "Thanks" button can I just say what a superb job xxxLazyDaisy has done on this thread.
The OP appears to have been teated terribly (and completely unlawfully) by this care home and I do hope her insurance will take it on and provide a lawyer who will take as much care as Daisy has given for free!
I do hope you get some worthwhile compensation, partly for the horrible way you have been treated but also to teach the organisation a lesson and protect others in the future.0 -

Skib, just reading the your earlier posts - the second letter you received from the manager says that she had discussed the matter with HR and the Operations Manager who had advised that you must be seen by an OHA before the application can proceed. I wonder if this is the same Ops manager who wrote to you recently? In which case, it is a pretty fair bet that s/he knows a lot more about your case than they are letting on... and the radio silence is more that a coincidence.
I'd be really interested to know what involvement the Operations manager has had behind the scenes - OP's lawyer could really rattle some cages with the discrimination questionnaire.

This is an interesting recent court of appeal decision about extending time for making a discrimination claim, and when a series of acts become 'one continuous act' and when they should be viewed as 'separate acts'.

Personally I think Skibadees experience should be viewed as one continuous act of discrimination - but I wouldn't want to bet my house on it, so the best and safest course of action is to assume time runs from the date of the first clearly identifiable act, which is when the job offer was withdrawn.I'm a retired employment solicitor. I had a phonecall from their OHU today, after discussion details were passed to their Doctor, OHU rang me back later, Doctor had no concerns but is making the following recomendations..
Manual Handling Training.
I may need above average time off due to medical history.0 -

Remember if you wish to make a claim for unlawful discrimination, you should get your claim in before christmas to be on the safe side.
You can still make the claim and accept the job.... but it won't make you very popular.
