Just had a crash, who's fault is it? Need advice please

    I was in slight shock, but was ok to drive home straight away. Was going to the cinemas with mates but obviously I was in no mood to watch a film with what had happened.

    Unfortunately roundabout accidents similar to yours tend to be settled 50/50.

    my complusaory excess is £150 plus my vol of 350 so 500 altogether.

    I've sent her a text a said what is she planning on doing. She is a driving instructor with BSM. She hasn't got back to me and I sent her a text back to her 10 in the morning.

    If she don't get back in touch with me I'm not going to either and just fix the car door next year when I come to selling. I won't go through the insurance either too much hassle.

    It seems what people are saying if I make a claim, my insurance will go up, regardless if I win or not.
    I have to pay voluntary excess (350 + 150) = 500 not worth it. - As it could be seen as a 50/50 case
    I will have to put down on a new quote that I had to make a claim next year
    Might lose my NCB.

    The cons outweights the pros. It's a good job I couldn't put £1000 for my excess on my insurance when I took it out.

    The damage to her car is not very much, won't cost more than 100 to fix. It's also her company car also..

  • this is what happened. I am the green dot, she is the red dot, I don't know if she came from the rear side of the roundabout to get on the roundabout, but let's assume it was like this.

    Problem for you is that she says she was in lane two and you were lane three. You may struggle to counter that, and it may in fact be the truth. What does your independent say?

    My opinion is (based on your 'dots' view) is that red; definitely in the wrong lane unless taking the first exit in lane 1. It would also appear that there is a tyre mark on your door indicating that you were ahead of her at the point of impact. Green dots; correct lane for taking either lane 2 from the first exit or going straight ahead.

    Conclusion (in my opinion) TP at fault. God help anyone who she teaches to drive.

    I would not expect BSM to accept your offer to sort this out without going through insurance.

    will you indicate where you were on the roundabout when you indicated that you were going to leave the roundabout

    Hmm.

    Independent witness says he seen her basically speeding up on the left side, indicating right and then moving over to my lane then her crashing into me as I turned in, to the second exit. He says I kept to my lane throughout and I shouldn't have to worry because she came into me and I was in the right lane because there are two exits lanes for the exit I was taking.

    Hmmmm

    I indicated around two dots before the blue X mark.

    I've phoned her and phoned her constantly, and texted.. she is obviously ignoring me and that number must be her personal and driving instructor number as when it goes into voicemail, it says I'm currently in a lesson, blah blah blah.

    Does anyone know how long she has to report the incident to her insurers? Surely, the longer she leaves it, the less likely chance of her winning her case?
