RAF lad gets Fine from Service Station

Hi Everyone

I do hope you can help.

My brother is based down south and today heading back to work from home which is Burnley he was feeling tired so he pulls in to a service station and decided to have a nap.

All the signs kept saying if you feel tired pull into a service station. He did this, he said he did not see the sign that said no longer than 2 hours and was given a £60 fine.

I was told he did not need to pay this because it was not issued by a police officer or a traffic warden.

He's just done the Olympics for the security and i think this is disgusting. His girlfriend is on tour at the moment, he really does not need this upset.

Could someone please advise what he can do?

Really would appreciate any help offered with the law here.

Thank you.

Portraits Hero.

My bro said... It says if he don't pay by the 12th it goes to £90

It's not a fine and it can be ignored. Please read other threads on here that deal with private parking matters.

As the sum does not represent a true loss to the landowner, the charge is invalid, as its a penalty charge ( fine) issued by a private company.
under UK contract law, private companys can not issue fines or penaltys.

Best option ignore, there is a fight option as well, if you tell them to go away and stop sending letter, and then they continue technicaly they can be done for harrasment putting the boot on teh other foot so to speak.

Your easiest option is to ignore all comunications with them.

his job does not come into it the traffic warden would not know what it is he does

if the signs were clear ignorance is not an excuse

but i do believe you can question penalty fines ignore them cause they are not enforcable

That's the wrong advice, with respects. The invoice is today

    We need further info

    1) where exactly did this take place?
    2) who issued the invoice?
Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?

The OP said "service station" which I imagine is situated on a motorway, so most likely a private parking ticket.

Tris sorry but keeper liability is in from today, so if the op has an invoice from an AOS member in England or Wales , we should be advising to appeal to the parking company, on the hope of a popla appeal if its turned down.

Stafford in both directions appears to be CP Plus http://motorwayservicesonline.co.uk/Stafford_(South)
    http://motorwayservicesonline.co.uk/Stafford_(North)

Clicking through the CP Plus link on that page gives some 'interesting' information - almost taking both sides of the fence, but also using the f-word

Instead of continuing with all this poor advice, which is confusing not only the OP but any others reading this thread, why not stand corrected/remove the "advice" and advise the OP to go to pepipoo for some correct advice?
