Unjustly accused of fraud by Lloyds TSB

There was another thread on here relatively recently with similar facts - may have been a different bank but I assume that others are cynically linking the two threads / user identities...
Irrespective of the comments, it might be worth doing a forum search or looking back through some of the index pages over the last month or so, to identify the relevant threads as they may contain some useful info.
As to length of posts, sometimes you can't win. People get criticised for only revealing info as the thread develops, and also for over-long posts. Although your post was long, it's got decent punctuation and paragraph breaks so I found it easy enough to read. Don't worry about it.
The poster above who says that you need to wait until your complaint has gone as far as it can with LTSB before going to the Ombudsman, is correct. The formal complaint letter is the right thing to do for starters. Have a google for Treating Customers Fairly - it's something the banks have signed up to, and it may contain some useful info (I haven't read it myself so don't know for sure).
Under the Subject Access Request part of the Data Protection Act you may be entitled to the transcripts / recordings, but you may find that they refuse to divulge them on the grounds of fraud prevention (!). I'm not sure how best to resolve that one.
It might also be worth checking your credit reports in a month or so's time, plus on the national hunter database (industry fraud database) if that is possible, to see whether LTSB have put a marker on there because that has serious implications for any future credit or banking issues.
Edit: I may have meant the CIFAS database rather than national hunter.0 -

Thank you for your sympathy, and no this is not a wind-up. It's disgusting that this sort of thing goes on with the customer left helpless. I'll certainly keep this thread updated with the progress and hopefully this might help anyone that finds themselves in a similar situation in the future

Have you googled the sender?:heartsmil When you find people who not only tolerate your quirks but celebrate them with glad cries of "Me too!" be sure to cherish them. Because these weirdos are your true family.0

Here are some previous threads which may possibly contain some info on similar issues such as unprompted payments in, and unexpected closures, as well as complaints matters:

I have no advice OP - sorry - but just wanted to say I read all of your post easily and quickly as it was so well set out and punctuated with the correct spellings, much easier to read than many other shorter posts on the forum. There are loads of great posters on here so don't be put off by a few who are less than sympathetic.
Your experience sounds awful - good luck.0 -
I have skimmed your post, OP but IF the issue is that someone, somewhere is attempting to deposit money into the account of your girlfriend why not ask the bank if they can close that account and open a new one for her?
(and the reason I skimmed is because I can't find my specs)Don't put it DOWN; put it AWAY"I would like more sisters, that the taking out of one, might not leave such stillness" Emily Dickinson

Punctuated with the correct spellings you say so what about if someone joined the forum who's dislexic and struggle with spellings then what? Would you take the pi*s.0 -

How is your comment at all helpful or relevant to the OP's thread?
This poster was merely trying to be supportive and encouraging to the OP - who is a newbie - in the light of abuse or unhelpful posts.
Don't derail this thread in pursuit of some issue you may have.0 -

I think the bank will refuse because they accuse the OP's girlfriend of being party to a fraud - and therefore don't want her as a customer at all. And will put a flag on her details so that no other bank will want her either.0 -
Some high level info as I don't want to be seen to be dragging my post out:
Open a complaint with Lloyds (join the half million people who have complained against Lloyds so far this year). They have 8 weeks to resolve the complaint or provide a final response - once this has elapsed you can then take this to the Financial Ombudsman Service - as stated before you cannot go direct to the FOS - you need to exhaust the Lloyds complaint first.
Secondly - under the DPA as already stated you can apply for a Subject Access Request to which Lloyds can charge you £10 and have up to 40 days to provide the info. However as already stated if they believe the information supplied could be detrimental to a future fraud case they can refuse to give this.
Hope this helps!
