Did she call it a 'fine'?

What makes her think a private company or person can 'fine' someone?

My BS detection meter would have broken at that point. Claiming to have statutory authority (which is what she is doing if she says its a fine and its legal) is very very naughty indeed and she needs to be very careful what she says.

Did you record the call? If not, call back and ask her to put her request in writing. Let's see if she hangs herself.

yes she called it a fine and yes she said its totally legal.
she also said when i told her i had researched it online that lots of people post up on various sites as they are just angry cos they have been fined LOL LOL LOL
i did not record the conversation.
what would i ask her to do re hanging herself exactly?

See if you can get her to confirm that she'd like some receipts, and if she doesn't get them then confirm that the fine stands.

Or... just ignore the silly woman!

Better still get her good friends at PE to confirm that you park there regulalry ;)
  • Sounds like time to fill a huge trolley at Aldi and then abandon it near the tills saying you'd forgotten you need to use your shopping budget to pay Aldi's Parking 'fine'.

Never use aldi again - I've had problems with them in the past trying to worm out of their responsibilities when returning a faulty item. They tried to tell me to take it up with the manufacturer. They knew they were in the wrong because as soon as I mentioned the sale of goods act and county court they couldn't refund my money quick enough. Shysters just like the PPCs they are in league with.

    hi again,
    update..... update..... update
we received another letter this morning from parking eye.
two photos of our car, arriving and leaving aldi's carpark plus a big

    black banner across it saying...

    parking charge amount due £70
payment to be made by 12/11/2012
this parking charge is discounted to £40.00 if paid by:29/10/2012
after this date, the full parking charge amount will be owed.

has anyone else had letter like this?
i cant find anything like this on the letters that had been uploaded on here?

under the twp photos of our car there is a lot of text saying there is lots of signage up in the car park and that it is private land.

    any thoughts guys?

    cheers

    Yes, its still unenforceable tosh.

No amount of text in a letter will get them around the fact that only the landowner can forma contract with the driver (and hence pursue a breach of such contract) and that they are entitled to their actual financial loss only.

    That's contract law for you.

That's another parking charge then, same as everyone gets and another one to ignore.

Your letters should be in the links on the fifth thread down, 'PPC letter chains' which is now divided into pre and post-October pictures:

    http://forums.moneysavingexpert.com/forumdisplay.php?f=163

Just play snap with your letters, as I understand it you have 2 fake PCNs now, same as the number I have ignored so far. My 18 yr old niece has ignored SIX fake PCNs from Parking Eye and sends me a cheery text whenever she collects another one!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

There are plenty other examples of this here - many other firms use a similar "discount" offer - its usually a sign that you are very near the end of the scam. :)
