Bought Car And Just found out its been clocked. Where do I stand

    Ebay ads are not proof of sale.

    Ideally you should take someone knowledgable about cars, there's a big difference in the quality and feel of a car that's done 125k and one that's done 220k. On the latter the seats, pedals, steering wheel, and all the other bits and bobs that come in contact with the driver and passenger would be work out. It would be obvious that it's gone round the block a bit.

    And to my horror the car had done over 220,000 miles. The car has been clocked. The last mot was August 2012 with the correct mileage.

    On my invoice I noticed he put mileage 125,000 not warranted. And sold as seen. Trade sale
    Where do we stand. This is fraud. On the eBay listing at the bottom of the description he has put sold as seen no warranty given or implied

    Is there really that big a difference, pedals, seat etc can be worn at 100000 depending on how the car has been used, in fact I have just seen a car with 20000 miles on but the seats look like they have done over 100000,

    OP what exactly did the ad say, can you link or provide seller ID

    As others have said as its a trade sale you should be entitled to money back, its getting it that may be the problem

    i have contacted dvla, vosa, ebay, police and trading standards. dvla and vosa were very helpful and the police were useless saying contact trading standards.

    trading standards have asked me to send a letter recorded to the sellers house. i have given him 7 days to pick up my car and give me a refund as the car has been clocked.

    the interior was in excellent condition which i found strange as its done over 220000 miles,i think he replaced the interior. the drive of the car was awful as i found out on the way home. we took it for a test drive just round the block as i didn't know the area. seller waited in the house while we both drove the car

    As others have said as its a trade sale you should be entitled to money back, its getting it that may be the problem

    This has just came in to us as a p/ex and is here on ebay to be sold at a bargain price

    As you can see from the pics this is a very good looking car
    its finnished in metallic black with black leather interior
    the bodywork does have marks around it
    the worst are shown in the pics
    also there is a headlight washer jet missing from
    the front bumper and a scuff where it was
    but the car still looks nice and respectible


    The interior is in great condition
    There are no major marks on the carpets
    its very nice and comfy with loads of extras
    all the electrics ect work as the should

    It starts first time every time and drives great
    it pulls very well and changes gear nice and smothly
    all the brakes and suspention feel very good
    its very nippy but still great on diesel

    First thought is not to buy a car from a trader that can't spell.

    Second was it a classified ad or a buy it now auction type thing? it's just that this:

    makes it sound like you didn't actually buy through eBay in the end. (Appreciating you handed over cash) If that is the case and/or it was a classified listing eBay won't care.

    However, the chap has promised it is 100% accurate so clearly a lie. Have you spoken to Trading Standards yet?

  • Did he give you the tear-off slip from the V5 (logbook) that the new owner is meant to be given?

    For next time around, once you've got your money back and buy another car, never hand over your cash without doing an HPI check first. It should have shown the mileage discrepancy.

    Think I've found your seller on eBay BTW, based on the ad and location. It's definitely a trade seller - there is no way he could get away with claiming to be a private seller in the event of a dispute.

    it was a buy now & make offer, we have contacted ebay and they were very helpful and the told us to contact the police. so they can contact ebay for them to carry out there investigation.

    we done a text car check but came back without the mileage

  • just a thought!! I have not driven the car since monday and do i need cancel the insurance as i rejected the car. and the car has no tax, the seller told me that the previous owner have kept back the tax disc for a refund and said to us, that we have till the end of the month to get one, don't know if this is true.probably not. if not shall i get it sorned as i don't want to buy tax for this.
