I think you have a case.
If the company stops supplying the service you are paying for, then this could mean that the contract becomes void.

Nope. The service continues as before, so there is no issue. Technical issues are dealt with by rebates until full service is restored. As for te contract becoming void? READ it, it doesn't.

not sure i quite follow you?

what service continues as before? the one i, and hundreds of others in CF64, havent been able to use for 3+ weeks?

and the statutory rights in the Sale of Services Act 1982 overides their contract as said a few times above?
  • just for the record when this goes to court:

    1. Still no signal
    2. Still no repair date from vodafone
    3. Other people suffering who were promised reduced payments this month have had their normal full payment taken
    4. Some people have received letter from vodafone saying that no automatic compensation will be made only after people make a claim in writing once the service has been resumed
    5. 23 days without service.

I just like their way of thinking. If the service is never resumed, they don't pay any compensation then. What's the point in moving their fat asses then?

  • Hi Lee

    Thanks for the update.

For those of you who havent been able to find the message on the VF Eforum here is the response..

"We’ve been investigating this and it appears to be due to trees causing a line of sight issue on one of our masts. Unfortunately the land owner won’t allow us to get the trees pruned, which means we need to look for an alternative solution to the problem.

We’ll keep you posted when we have any more information, but unfortunately at the moment this issue is beyond our control."

Which doesnt seem to stack up as one of the people on the list suffering from this problem lives in a house adjacent to the land where the mast is located... hmm

The line of sight issue is probably that the mast can't communicate with another mast, which it requires in order to connect to the network. Some masts are connected to the network by cable; others are connected over the air to other masts. This one probably uses the latter method.
  • ah, now thats interesting...another article in our local paper...

    I qoute...

"Vodafone has revealed the reason why some of its customers in Dinas Powys have lost their signal - and it's all down to trees.....

Jane Frapwell, of Vodafone said: "Unfortunately, our signal has been disrupted by the growth of trees - we need line of sight to be able to link the mast into the network... The trees are on private residential land. We approached the landowner in July as we were aware that the site was having intermittent problems, but the landowner was adamant he would not give permission to lower the height of the trees.....

"We are currently investigating other options, but they will be time consuming..." she added...

So Vodafone has known about this looming problem since July and has only now revealed it to their customers!!

its now online... interesting comment from Jane Frapwell...

"Mrs Frapwell said there were a number of other base stations within the locality providing coverage to the surrounding area, but users who had been left without service for an extended period may be entitled to terminate their contracts early."

    http://www.penarthtimes.co.uk/news/9951198.Vodafone_confirms_that_Dinas_Powys_signal_problem_is_down_to__tall_trees_/?ref=mr

which contradicts the email i received this morning from the Web Relations Team:

"Having liaised withour Customer Relations Department I can confirm that we'd be unable waive theline rental covering your remaining minimum contractual commitment with us. As such, once your final bill has been issued payment of this will remain due."

    outrageous!

It sounds as if they need to connect the mast to the rest of the network by cable rather than over the air. They should have foreseen the growth of trees when they originally surveyed the area for the position of the mast.
