Vodafone Mast Down since 2nd Sept - Still no service - Cancel contract under SOGA?

            As I have previously indicated, I am not in favour of sugar coating or pandering to the masses, so you should know that if you decide to go to court on this, not only will you find no sympathy, don't confuse compassion with sympathy, but will find yourself lumbered with the costs as well.0

 Good Luck, however if you cease paying unilaterally then you become the one creating the default not Vodafone. As such a default is perfectly valid on your account.
 Keep paying your bills but ensure they are marked as paid under protest.
 I would suspect if you did go to court Vodafone would settle outside the court anyway.0

 I don't think what I am doing would be construed as "unilaterally ceasing payment" I have emails going back over 3 weeks stating that i need this service and email replies stating they cannot tell me when the service will be resumed. (It's still down today)
 Also, when I spoke to Lee from the Web Relations Team yesterday he said that my account had been "put on hold", or whatever the words were. He said no recovery action would start yet....0

            Well today. I decided enough is enough.
 The mast is still down and Im still being treated like a mushroom by vodafone.
 I got my giffgaff sim this morning and have given them my PAC code.
 I await the inevitable court action letters from vodafone....

 I do hope they allow you just to walk away as you stated you were initially told, but fear for your credit rating. I would have continued to pay and fought the issue or got someone with "clout" to take up your issue.
 Fingers crossed for a happy ending.

            As you say. I am expecting retalliation...
 It could be:
 1. Court Action for breach of contract.
 2. Spoling my credit record.
 3. Blocking the IMEI of my phone.
 Quite honestly, I hope they try it. I think I've got more than enough ammunition to rinse them if they try it.0

            It will be:
 1. No court action, simply sell your debt to a collector of such things.
 2. Yes they will, which may make it hard to then get a new contract
 3. They will more than likely not blacklist the phone, as technically you own it.0

            I think you have a case.
 If the company stops supplying the service you are paying for, then this could mean that the contract becomes void.
 An outage of a few days is just bad luck but it has been out for weeks now with no end in sight. Presumably there has to be a point when the lack of service voids the contract. At least that would be the case with a landline.
 What I don't know is how long it is reasonable to expect you to wait, but it can't be indefinitely otherwise you could be waiting until the end of your contract ie your contracted service never resumes?
 Unless mobiles are treated differently to landlines?
 PS As long as you are in active dispute with the company, then I don't they can put an adverse reference on your credit rating as that could be considered defamatory.
 All this is a good reason not to use contracts. PAYG is the safest way.0
