I received a pcn charge ,I have no intention of paying but worried about new law I live Glasgow so wondering if it different in Scotland as elsewhere have received letter from town and city stating that I wasn't parked in bay and the charge had gone up, as stated no intention of paying so where do I stand regarding new law October 2012 ps am a newbie cheers0

The new law doesn't change anything. Once an unenforceable invoice, always an unenforceable invoice. It's worth quoting this from a PePiPoo thread:-
There is a lot of misinformation around concerning the Protection of Freedoms Act. This is largely pedalled by the private parking companies in an attempt to add some kind of legitimacy to their charges, not helped by sloppy and lazy journalism which regurgitates what the parking companies say without checking if it's true or not.
Schedule 4 of the Protection of Freedoms Act 2012 introduces the concept of Keeper Liability for private parking charges if the registered keeper fails to divulge who the driver was. That is all.
* It does not make parking charges enforceable (or any more enforceable than they were before, which, on the whole is not enforceable at all)
* It does not require the registered keeper to name the driver on request - there is no obligation. If the keeper fails to name the driver, the "liability" (such as it is) reverts to the keeper (see previous point). If the driver and keeper are the same person, then there is no difference anyway.
* It does not set out any kind of statutory framework for parking charges, they are still based on contract law or trespass, and in that respect nothing has changed
* It does not define the wording that must be used to make parking charge notices "legal" or "enforceable". The Act sets out wording and points that must be included in order for the parking company to be able to apply keeper liability, but using all the correct words does not make the notice any more legally enforceable than it was before (see point 1)

There in no new law in Scotland or NI. This only applies to England and Wales.0 -
Today I received my second letter from Debt Recovery Services. It says that to prevent potential County Court proceedings issued against me, payment must be made in the next 7 days. For 110 quid.
It says if I do not pay or contact them then they will assume I am avoiding payment. "In this situation out solicitor may issue County COurt proceedings against me". It then goes on to say if County Court Judgement is obtained then the amount I owe will increase:
"A COUNTY COURT JUDGEMENT MAY SERIOUSLY AFFECT YOUR ABILITY TO OBTAIN CREDIT IN THE FUTURE"
At the bottom it then says I can view a selection of CCJs they have obtained against people who have ignored their corresponence on their website...
i am aware everybody has said this is still not valid, and i believe they design their letters in a way that will scare people. when you look closely you can see that it is all a bit vague...
shall i just continue to ignore it and hope they give up?
i am a student and i can't afford to pay this unfair charge!0 -
Yes ignore them, this is just part of a series of threatograms you'll get, once it goes through to the end without payment they will go away looking for an easier person to threaten with their illegal demandsExcel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
