Bailiffs cannot come and sieze goods without a court warrant. They cannot get a court warrant without you refusing to pay a court judgement. They cannot get a court judgement without taking you to court and winning.

You'd know if that happened.

It won't though, they'd lose badly in court and they know it.

What you are doing, and what thousands of other people do on here, is mistaking debt collectors, who have no power other than to politely ask for the money, and bailiffs, who cannot be appointed until various court processes have happened, court processes which you would be informed of, and have the opportunity to defend and then settle.

Relax.

PS - Which thread did a bailiff turn up and sieze garden furniture?

Probably nothing to do with private parking . More likely a "real debt", such as Council tax or utility bill.
What part of "A whop bop-a-lu a whop bam boo" don't you understand?

I would rather pay than have bailiffs pestering me and my young family as I have seen in some threads they have actually done and taken garden furniture and toys!!! Will they do this and why do some bailiffs act as stated in some threads I am reading and some say they won't!!!

You are getting muddled from all your reading - there are NO private parking threads on any forum in the UK which talk about bailiffs removing goods. THIS DOES NOT HAPPEN WITH FAKE PCNS.

I suspect you've followed links and read info about NEWLYN BAILIFFS. But you are not dealing with them, you are deadling with Newlyn's debt collector section. And you don't even have a debt. Newlyn are one of the 'worst' debt collectors - but only in terms of their letters being especially misleading because they have the word 'bailiffs' as part of their company header. Even when not acting as Court bailiffs.

Any help appreciated as I am still slightly worried and think I should pay the money rather than the Hassle of the letters calls n bailiffs?

To coin a phrase from a cat on Russell Howard's good News:

NONONONONONONONONONONONONONONONO!!!

Of course you don't have to pay! You do not even have a real parking ticket, it's just a piece of rubbish.

Like all the other posters on this board, you have a fake PCN. The letters are easy to ignore and laugh at, when they arrive at the address of someone who knows it's all hogwash and not a real parking ticket at all.

The whole scam of fake PCNs relies firstly on people's ignorance of the fact that a random private company can't fine anyone, and secondly on their natural fear of parking tickets and the escalating costs/bailiff scenario. So PPCs copy the look of a real parking ticket and - hey presto! - the cash rolls in from victims who know no better.

There is no fine, no CCJ, no bailiff, no debt, no Court, no effect on credit rating, no repercussions at all.

Tick off the threatening letters here.

Watchdog clip with expert Solicitor's opinion here.

Barrister's opinion here.

Why not read the forum and stick to threads about PPCs and their debt collectors, not bailiffs which is irrelevant to you! Laugh at the scammer and their attempt to extort money. Collecting and ignoring each letter is like deleting obvious phishing emails from your 'Bank'; it's a very similar con based on impersonation of authority. And we have the preview pictures to help you.

Soooo glad my regular posts are pi55ing some PPCs off and I am not surprised. I have had dodgy pm's in the past with threats. :)

To the OP, look at the latest posts from today only, on this thread:

https://forums.moneysavingexpert.com/discussion/comment/56805691#Comment_56805691

Send a complaint email to the DVLA with copies of your letters and say that it seems that Newlyn plc (the debt collector side) are apparently not actually a licensed debt collection company and yet the BPA haven't noticed? Give the info from that thread and tell the DVLA that you have personally received letters this week and cannot understand why this firm are still on the AOS list. And in addition to that, on the Newlyn plc website they have misleading 'debtor information' if you scroll to the FAQs:

http://www.newlynplc.co.uk/pages/debtorinfo.html

''Who are Newlyn?
Newlyn are a bailiff company who have been instructed
to recover a debt on behalf of our client as you failed to pay
them in the first instance. We have been instructed by our
client to enforce a Liability Order/Warrant of Execution
which has been issued by the courts.''

ASBSOLUTELY NOT TRUE IN THE CASE OF A PRIVATE PARKING 'TICKET'.

You could use an anonymous name if you prefer as long as you give some definite information to the DVLA.

Send it to mike.butler@gsi.dvla.gov.uk

Kirky,

You say that you have received threats of CCJ and Bailiffs. Have you received a letter from Newlyn indicating bailiffs? If so, could you post back with the actual wording used in the letter. This CANNOT be allowed.

Herbie have you heard anything from the bpa or dvla on the complaints you sent ? Because I'm waiting on complaints I have sent regarding the contents of this thread and others.
Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?
