Hi All,

your input will be very much appreciated here, I have received several letters for a parking offence in an NCP carpark. I had parked over the white lines, TBH i was aware of this but everybody else in the line had done the same and I just jumped onto the end of a line of cars who were all out side of the lines as it was the only space that I could find (top floor) . When I returned late in the evening hey presto all the other cars had gone home , my car was left on its own with a parking ticket on the screen. When I came home I did try and pay the fine with the details that had been provided but their system didnt recognise my details or their own reference number. So feeling a little peeved I did a google and found a load of info that said discard the fine and dont worry about it, this is what I have been doing but yesterday they phoned my home and left a message for me to contact them urgently. what should I do ? call them or ignore ? I dont want to have a baliff or court date. I know my head says ignore based on the info but seeing as they are actually calling what should I do ?

    You keep ignoring them or you answer once to instruct them to desist and keep all further communication in writing - which you then ignore. This is not any sort of fine, so you should be glad their system stopped you from paying it.

    These goons have no power to do anything and they cant send bailiffs to your door without your losing a court case and failing to pay the judgement, which almost certainly will not happen. :)
  • You won't get a bailiff or a court date. Ignore them. If you answer the phone to them, admit nothing (not even your name), but tell them that the alleged debt is denied, and that they should refer this back to the originators (the PPC), and that any further communication from them will be regarded as harassment, and reported to the appropriate authorities. Then put the phone down - don't enter into any debate with them.

    The alleged so-called debt is denied. You must now refer this matter back to your client. Any further communication on this matter will be regarded as harassment under terms of the Protection from Harassment Act 1997.

    Make a note of the date and time of the call.

    As debt collectors, Newlyn have the same legal powers to collect debts as you or I. Not that this is actually a debt. Did you take out a loan and enter into a credit agreement with the car park owner? You'd think that a debt collector would know the difference.

    The final but more unpleasant threats usually include mentioning that, if the case goes to court, a county court judgement (CCJ) may be issued, that bailiffs may be appointed and that your credit rating may be ruined.

    For things to actually get to this stage, the car park owner would have to take you to court and win the case. Then, you would have to refuse to pay, to get a CCJ issued after 28 days. Then, you would have to still refuse to pay, to get bailiffs appointed.

    NCP do own car parks, but they don't do court. They know that enough victims pay up for them to make a profit, and that having their dubious business practices subjected to legal scrutiny is the last thing they need.
    The acquisition of wealth is no longer the driving force in my life. :)

    cant believe you mention the word bailiff????,you have not committed a crime/offence, you have a PARKING charge notice=fake/scam/con/do not pay,,,only a PENALTY charge notice is legit, so why this concern,take advice give of ignoring,or telling them to stop calling, but they will go away sooner if continue to ignore, because they dont know who on earth they are ringing,, its up to you,remember its a scam anyway.worry not, feet up, glass of wine, come on england.

    Many newbies make that mistake when they get a Newlyn letter, because Newlyn's letter-heading is misleading. As we know, they do, separately, sometimes act as Court bailiffs and for some Councils, and their headed notepaper uses the word at the top.

    Horribly misleading tactics. With a fake PCN like an NCP one, Newlyn are only acting as debt collectors not bailiffs. And NCP don't take people to Court anyway, not over a single fake PCN.

    NCP's signage on some sites is shocking, IIRC it talks about the 'driver, keeper and any passengers in the car' being responsible for their charges! As if! And the DVLA are aware of this.

    lanec_98, if Newlyn ring again use the wording in italics from Stephen Leak and then put the phone down. Do it again if need be, don't be drawn into any other conversation. You are near the end of this scam.

    You could tell them to eff off each time they call, I believe they will take you off the calling list if you are swearing at their staff, I haven't done it myself but somebody posted it on the debt free wannabe forum ;)
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    Just ignore them they are just hopeing your a simple soft touch like many other people out there and then scam your money off you.
    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:

    @lanec: As a former car parking industry employee with 2 councils and 2 PPCs I think I can safely say that you won't be hearing anything from a court or bailiff about this so called debt. It's a scare tactic for easy money and always has been in the PPC world. The only time you need to worry is if you get a legitimate council PCN. Anything from any large PPC like NCP can be safely ignored. Sure, they may get debt collectors involved to try and scare you but that is all they can do. Believe me, I've had supervisors at one of the PPCs I worked for admit it (and seen the blagging letters stored on the shared drive).

    The only reason they are bugging you is because you tried to pay and they think you will still pay if they scare you.
