simple did you or wife have a incident or near miss on or around them days in that area or not ,
    answer yes or no
if yes that might be it
    The answer is no.

Mindless Clone, thank you for the very helpful post.
This was about 10 days ago. I am not sure if there was a CCTV, but vaguely remember one around that area (you know the one, big blue one on an independent post high in the sky) I will check.

It is just a sad fact of times that people 'engineering' claims are on the rise these days. I will ask the Mrs about the possible scenarios you raised which certainly I have not thought of some of them.

Also, I will contact the police and clarify what the alleged incident is and take it from there.

I have been hit in car park and no notice was left for me before, so I know the feeling.

    Many thanks

I agree with the suggestion to go over to pepipoo.

However, as the s.172 notice is unclear, my thoughts are that your initial response to the police (send either recorded delivery or get a free certificate of posting, and take a copy of your response before posting) should be to write back and ask for clarification of whether they refer to the day or the date as the notice cannot be correct.

    No. This is poor advice.

Get proper advice before you contact the police!

Can you clarify why you think this is poor advice, please, Quentin?

I agree, if the police cant get the day and date to match what else might be wrong with the notice?

  • Dear all

We received a police letter regarding failing to stop/report an accident. I suspect the police might have been misinformed and there is a possibility of fraud as we can not remember hitting another car.

Something similar happened to me back in the 1980s.

I received a letter from the plods informing me that a car matching the description of mine had been involved in a hit and run, and the location was in northern England somewhere, so I knew it couldn't have been me because that car had never been north of Guildford.

It was requested that I report to a Police station with the car so they could inspect it, so I did that and I heard no more about it.

IIRC they told me that a witness had reported a partial number plate so they were checking out all cars that it could have been.

It's a long shot but could your case be something like this?
  • OP asked originally how to challenge the claim on a technicality. Maybe Quentin is suggesting that pepipoo will be able to help you do so, whereas just telling the police that they've screwed up the notice means they can reissue it and then you've lost that avenue.

Perhaps it depends whether you want to get off on a technicality, or genuinely clear your name.

By way of "you don't actually have to hit something to cause a collision" I watched a BMW X5 round a bend on a single track road at the weekend far too quickly and force a cyclist into a hedge. Although they pulled into a passing spot I believe it was because they couldn't get down the road as a vehicle was coming. they didn't ask the person if they were ok. I was next round the bend and asked the chap if he was ok and he said yes but if the BMW had driven off he could well have reported them although no actual impact took place.

Could have been something similar if the street is narrow as the OP says.

    5t.
What if there was no such thing as a rhetorical question?

Have you read the OP's reason for asking for advice?

.....Is there a way of challenging this on technicality ground if you know what I mean?....

If you cannot see why your suggestion that the first thing to do is write to the police to point out to them their notice is incorrect and will they please clarify it is "poor advice" then I can't help you!
