I believe that what the OP means when they say it is not in their possession is that when it was stolen it was never recovered. In other words it remains stolen. Please correct me if I am wrong.I was never advised that in theory if a mobile is found, that I should return it to them (logically I paid in addition to the monthly contract another sum of money for a replacement). .It's not just about the money0

Reading this particular post, it smacks of evasion and a certain concealing of facts.
A straight honest person would have said something like "it was stolen and I don't know who took it" Sound like you know where the handset is and who took it.
Also, none of your posts have actually said you have had an insurance settlement.
I'm sorry, but your posts are all a bit fishy and if you have had an insurance pay out and you know where the handset is or who took it, then that information should be given to the insurance company and police.
Try being straight, both on this forum and with the insurance company/network.
You've read the posts exactly like i did and picked up on the same wording, very evasive responses to the actual whereabouts of the phone and actual current ownership.0 -

Well in that case without the facts laid out bare then we cannot be expected to give an opinion on whether or not you have been duped by your phone company. Answer the following questions honestly and you might get some honest feedback.
1. Was the phone ever stolen or was it just lost?
2. Did the phone ever end up back in your possession at any time for any length of time since it was reported as stolen?
3. If the phone did end up back in your possession do you still have it did you give it away, did you sell it, or did you return it to the phone company.
4. If the phone did end up back in your possession did you ever advise the phone company or the third party insurer of this?
I suspect there a few other questions that people would like to ask aswell. Just to clarify, this isn't a witch hunt but the answers to these questions have a direct bearing on whether or not you have a case against your phone company.0 -

If this is the case then the next obvious question is to ask why your phone company believes you have recovered the handset? Have they said anything about this?

Maybe being unfair without the details but I think the likely scenario is
OP's phone lost/stolen, phone gets blocked and insurance pays out
Phone gets found/recovered returned to OP
Only person who can get it unblocked is the owner (OP) which of course flags up the phone as back in circulation and the underwriters want the phone or their money back.
OP meanwhile gives/sells the phone then gets hit with the £200 bill they didn't realise would be liable for.

Just to be clear, I didn't think for a second that you were concealing facts, nor do I think you are lying. I simply needed a bit more information as the facts as they were previously laid out were not adding up.
As I said before, the question you need to ask your phone company (and ask again if they haven't satisfactorily answered you) is under what circumstances they have come to determine the phone as recovered? In other words, how do they know it is no longer stolen and why do they think that it is in your possession?0 -

OK. But you made a rod for your own back by your carefully chosen words. Even your last 2 posts seem to have carefully chosen wording that doesn't quite answer the points without evasion, particulary answers 3 & 4.
Let me ask another straight question.
Do you have any idea who stole it - ex-boyfriend, relative, friend etc?
I agree that networks don't work on here-say and, assuming that you had the phone and sim blocked when stolen, then has it been unblocked? If you don't know then you need to find out from the network and get it reblocked if, as you say, it is still stolen and its ownership, whereabouts are not known.
Only you or someone who had intimate knowledge of your details could have got it unblocked, unless, of course, it is overseas.
Still a bit of a Billingsgate odour here.0 -

No, I'm not working at the police. It was stolen by a thief, not a friend, not a relative, not an ex-boyfriend.Only you or someone who had intimate knowledge of your details could have got it unblocked, unless, of course, it is overseas.
I have no idea if someone spoke to them . I definitely didn't because the phone is stolen.
