Bailiff Taken my car because of fines incured by previous owner.

Hi.
I Brought a car 6 weeks ago and the keeper gave me the new keeper slip with my details on and a receipt to confirm the sale. However i never received the logbook and i moved from that address 3 weeks ago. (the move was sudden as i went through a break up)

However, yesterday i went shopping with my mum in her car and left my car parked at my address and when i returned , it was gone! after calling the police who confirmed that it had been took by a bailif , i called the bailiff who said that there are unpaid parking tickets owed on the car but with the previous owner as it wasnt my name he has on his records.

He gave me a fax number to fax off the new keper slip and confirmation of sale, which i did , now when im calling the man , he is saying he cant give me a direct number for the head office and that they only deal by post. this is crazy!

they are saying that i need to wait from a letter in the post.

i phoned dvla who confirmed that it has been in my name since 21st july and theres no way that the bailiff could have checked it yesterday like he said he did!

he is still stating that its in the previous owners name!!

im stuck!!! any advice?????

    Your car has been stolen. Report it to the police and don't let them fob you off with "it's a civil matter". It isn't, it's theft.

    Which bailiff company is this? I'm sure we can find their number easily.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx.     It's only theft if there is an intention to permanently deprive the owner. But this would be TWOC, taking without consent of owner. Police will be reluctant to get involved, though.

    A largely irrelevant distinction if I may say so. The police are reluctant to get involved in anything resembling a crime.

    have you been in touch with council concerned they are 100% liable for there contractors (the bailiff)

    you may want post on this site (its free) they have a sub-forum dedicated to bailiff issues and some very knowledgeable posters

    But your first compaint NOW this very hour, must be to phone up Havering Council and do not get off the phone until they have sorted it. If they ask for a copy of the new ownership proof then tell them you'll come down in person with it straight away as the car MUST be returned today.

    Newlyn are well known (they also pose as Bailiffs when collecting debts for PPCs), call back soon as someone will have full details. Get onto the council straight away, they've got the clout to deal with this bunch of grunts.

    before you get in touch with council go on this site to confirm the bailiff who removed your car is certificated (i assume they gave you paperwork with a bailiffs name on it)

    search by using the bailiffs name or Newlyn Collection Services

    if the bailiffs names not on there phone MOJ on020 3334 6355 to confirm
    1 if he is a certificated bailiff
    2) date of certification
    3 bailiff firm they are certificated to

    this is the ceo of the council i suggest you get on the phone to her (will be her PA secretary)

    tell them what happened and that the bailiff concerned is being obstructive because they wont give you any details of newlyns head office so you can get your car back) remind the council that if it becomes necessary you will be including them in any legal action taken to recover your car and costs associated with any legal action to include any cost occurred while they have you car

    as i said the site i referd you to previously is the best place to get help with this
