Hello Hochiminh and thanks for the reply. OK, I'll hang on to this letter and any further (which hopefully I won't get because it does worry me a tad!). You do put it in perspective however, when you liken them to emails from wealthy nigerian businessmen! Now that is scary! Shall definitely ignore and hopefully they'll go away and leave me alone!

I don't pretend to be an expert, I only joined today because of a similar parking (quote) "fine". But reading through the forums, watching the youtube clip and having had experiences with these types of shady businesses in the past, they can seem worrying but remember the civil court is impartial, and tbh they probably sympathise with people who are duped out of money by these dodgy companies, and don't take too kindly to being used as a threat against people.

I'm really hoping I won't end up in court! I haven't watched the youtube clip - must go and do a bit of reading around. Thanks again.

Its easy for me to say because I am not at that stage yet, but I would relish the court case because even if I was to pay the charge in the end I would know that at least it cost them some money too. And it annoys me to think they make so much money by misleading people. Ok I can understand supermarkets want to discourage people from abusing the free parking, but the companies they deal with are just chancers I think.

Thats a good point. If one kept all the threats they make and lastly the threat of court action and IF in the very unlikely event it went to court their threats could be used against them in one's defence. One would have to present them to the court in an articulate pointed way. I know I am baised against the PPC's but if a judge was impartial all the threats etc would not look good too good to me if I was one!

The worst case scenario is that you go to court and the court sides with them (there's a post somewhere with the statistics, there were only 50 cases or something out of the tens of thousands they threaten where the companies actually tried to take it to court and lost more than half of them) even if that happens you will only have to pay that same amount they are asking for now.

There is no need to keep private parking charge paper work.
If they sue you, which they never will, they would have to provide you with another set.
Plus the shredding is so enjoyable and therapeutic, an act of defiance and victory in one button.

  • Hi all,
Ive been reading these posts with interest, my experience of "civil enforcement LTD" is as follows:
girlfriend and cousin/2 kids took my car from newcastle to whitby on the 15/08/12 i received a parking enforcement notice stating on 01/08/12 the above vehicle was parked in th coop car park and ovestayed the 2 hours maximum stay by 8 minutes. £45 fine if paid within 14 days if not fine would be £90 so i came on this site took advice and ignorned it.
ON 5/09/12 received FINAL reminder total due now £90, once again ignored letter.
Today 14/01/13 received letter from "Debt Recovery Plus LTD" stating i now have 7 days to pay £140, same as previous post mentions being a member or British Parking Association BPA and that "courts do not look favourably on motorists who try to withhold information etc....." I am once again determined to ignore it and see what happens although girlfriend is now starting panic abit, one thing though i thought last time i checked on this site i thought i saw that it said somewhere that if you werent the driver you didnt have to tell them who was but cant seem to find that anymore, is this still correct? any further advice would be appreciated,
    Thanks

What further advice do you need ? Scroll up and read what has been said. The advice of ignore is current and the best thing to do.
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Try letting this link of results load and read current threads.

And this thread I started explains that the new law recently has not suddenly made a fake PCN enforceable!

    https://forums.moneysavingexpert.com/discussion/4360185

You do not even have a real parking ticket, it's just a piece of rubbish.

Like all the other posters on this board, you have a fake PCN. As long as it's not a company/hire/lease car then you can just ignore it and ignore the other letters that will arrive. The letters are easy to ignore and laugh at, when they arrive at the address of someone who knows it's all hogwash and not a real parking ticket at all.

The whole scam of fake PCNs relies firstly on people's ignorance of the fact that a random private company can't fine anyone, and secondly on their natural fear of parking tickets and the escalating costs/bailiff scenario. So PPCs copy the look of a real parking ticket and - hey presto! - the cash rolls in from victims who know no better.

There is no fine, no CCJ, no bailiff, no debt, no effect on credit rating, no Court, no repercussions at all.

    Tick off the letters here.

Watchdog clip with expert Solicitor's opinion (which is still valid except for the one thing that the PPC can now write to the registered keeper if no driver known) here.

Barrister's opinion - read the answer at the bottom, it's very clear! - here.

Just to advise that your other option (in England and Wales only, for an incident since 1st Oct and for AOS member cases ONLY) is to cost the scammers £32 by 'appealing'/complaining about the fake ticket. Then when rejected, appeal it further to the very new (untried but free and independent) POPLA appeals service. The decision is only binding on the PPC and costs them money either way - so us regulars would do that and then we'd go back to ignoring the PPC afterwards if POPLA didn't order the fake PCN to be cancelled! :p

If you prefer an easier life then I recommend you just play snap with the threatograms from debt collectors - simply choose to ignore and laugh at the scammer and their attempt to extort money. It's like deleting obvious phishing emails from your 'Bank'; it's a very similar con based on impersonation of authority.

If you'd prefer to appeal then do that ONLY if you are certain this is an AOS member (Google them, do not believe the ticket) and you realise it's all a bit of a farce & you know you will never have to pay (and by the way, always 100% IGNORE any non AOS member if you get another fake PCN, just Google to check each time and laugh at the rubbish!).

However, be aware that a fake PCN from an AOS member is no more enforceable than any other - it just means that the DVLA data is open to them and that POPLA is open to you if in England/Wales. You can still ignore it!

HTH and welcome to the club - we've all been there, done that (ignore option) with a few fake PCNs and a shedload of debt collector letters!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
