    OP will have paid Just Eat, just eat then place the order with and pay the takeaway used, but that is irrelevant. OP's contract is with the people he paid for the service - Just Eat.

    Im not sure that is correct (i may be wrong). I believe Just-eat are working as agents for the takeaways.. especially as during the ordering process the takeaway have the power to accept or reject the order.

    I've seen £3 bandied about. Where did this come from? (It's not in the OP, unless it was there originally and has been edited out).

    goater's 1st reply mentions £3, but this was made AFTER the edit to the OP.

    Goater says "partial amount of about £3" to be around the cost of a kebab, which seems an accurate enough guess to me.

    Yeah it was just a guess. Kebabs tend to be around the £3 mark. Of course if the OP posted the name we could all check it out on just eat ;)

    It was £3.20 actually :-)

    To the person arguing to leave it be - if you walked into a McDonalds and paid for a Cheese Burger and what you got was a Fillet of Fish would you leave it? It might only be £3.20 but why the hell should I pay for something I did not ask for and something I did not want.

    I also paid for the items with a delivery time of 45 mins, not 75 mins.

  • After a better look on just eat I really should have looked at the recent feedback. It would have stopped me ordering from them.

    If I was in McDonalds, at the counter and had just received it I would probably ask for it to be swapped.

    If they said it would be a while while they cooked the hamburger or I'd got the order home then I'd eat it.

    If I had to ring up 2 different companies, argue over whose fault it was, get advice on a forum and then ring up my credit card company and instigate a partial chargeback I'd probably just write it off as an unfortunate mistake that wasn't worth my time.

    Technically thats a high five moment as a fillet of fish is about £2.50 while a cheese burger is 80p :-)

    I must admit when I use Just Eat I am always missing something e.g. a can of coke or a tub of sauce. I tend to just write it off and not use them again (after posting a negative review). Of course a larger item like a kebab would annoy me more!

    Normally I would just write it off as I have done when they give me normal pepsi rather than pepsi max or forgot a little something. Their attitude when finding our where the order was and when I told them it was wrong is what bothers me more.

    I reckon it's a ploy to guarantee further orders. The same has happened to both me and another family member. Both received something different to that which we ordered and subsequently told that if we ordered again we would receive it free of charge. However, there is a minimum order of £15 so we reluctantly had to spend more money just to receive the "free" item :mad:
