    Just incase you missed the title of this forum it is 'consumer rights' not 'consumer rights if the sum involved is greater than x amount or as deemed worth worrying about by flopnoodle'.

    Be it £3 or £300 OP has the right to complain and to be honest I'd do it it as well for the principal.

    He did complain. He complained 'several times' during the slight delay with delivery.

    He then complained when he was offered a free item.

    I'd refuse giving a refund too if it guaranteed he wouldn't order again, sounds like a complaining pain in the ar*e.

    'Slight delay' = half an hour, seemingly spattered with lies of 'a couple of minutes'

    He then complained when he was offered a free item.

    A Free item from a takeaway who can't deliver what was originally ordered, can't deliver on time and lie about the status of the delivery.

    Aside from the basic fact that his contract is with Just Eat not the takeaway he has every right to complain. OP paid £3 to a company for an item he did not receive. Sounds like a consumer with a legitimate complaint to me.

    But the OP did receive an item. To get a refund would he not have to return the unwanted item?

    I am also not 100% sure that his contract is with Just Eat and not the takeaway. I am having trouble with lastminute.com who claim that even though I booked through them the contract is between me and the hotel

    Who processed the payment... if he paid the takeaway in cash then that could change things. In your case with the website, did they process your payment or did the hotel?

    Lastminute.com processed the payment. However they claim they are the booking agent of the hotel and have no responsibility for the booking.

    It's not actually just-eat thats at fault here, they just send the order to the takeaway, and pay them, thats it, It's electronic, so most of the time, the order goes through correctly.

    Best thing to do would be to of complained as soon as it arrived and was wrong.

    OP will have paid Just Eat, just eat then place the order with and pay the takeaway used, but that is irrelevant. OP's contract is with the people he paid for the service - Just Eat.
  • JustEat will refund if you push them hard enough, I had a similar issue.

    I disagree that they should just let it go - they ordered something, it was wrong, it should be rectified.
