    That will probably be OK. I would call them one more time and ask them if they are willing to refund or reschedule before you take it to the small claims court. Don't get in to too much discussion with him.

    was the letter you send headed 'letter before Action' - that's the standard wording that indicates, to the recipient, that if you do not get whatever it is you're after, ie a refund or performance of contract, you will take the matter further to small claims. However I'm using the E&W law here; I'm not familiar with the Scottish system but I am sure there will be a remedy under Scottish law. Hintza probably is, though;)

    if you do escalate a claim to court then you start adding your costs. At the moment you're after your £240(or the helicopter ride). If it goes further you start to add in other costs, including the cost of bringing the claim.

    I really dont think i could stomach talking to him again but will if you think its worth it...
    Valli....no i never headed it as such but i had told him prior to the letter that i was going to small claims coart
    Letter just says after the communications and conversation i had with (name) and date, that i had sought advice and that the contract i have with your company comes under the legislation supply off services and goods act 1982 we were prepared to go on the flight and due to wrong information and bad comunication on your part we did not recieve what we paid for , iam giving you 14 days to resolve this situation, iam sure he will know what it is because if this is the way he runs his company then iam sure he would have had complaints before.

    I think Valli might have a point, send him another letter clearly stating it is a letter before action and give him another 14 days. Get a COP.

    In the meantime you might want to see if you can ascertain if they did fly that day. Find out where they fly from (I assume you know this, but I would be interested in knowing). It might then be worth seeing if the civil aviation authority can help you (I don't know if they can or not but I would think they would have a record of all flights that day).

    If they did fly it might weaken your case.

    I have emailed the air traffic control at Glasgow airport asking if they can tell me whether helicopter flights took off that day from Inchinin helicopter pad Nether southbar farm Glasgow PA4 9NA so hopefully they can tell me but even if they did take off it doesn't change what the message told me & if that is the case then they still made us miss our flight.
    Last week i also contacted the met office and they want £70 for a historic weather report !
