Highview Parking Ticket & Couldn't access my vehicle

Hi,

I've come home from Leeds festival early hours this morning opened my post to find I have a 'charge notice' off Highvew parking.

First of all I was like oh god no! Thinking I'd have to pay up but I then read that I don't have to pay them at all and they have no legal powers etc. I also have a grounds to appeal anyway which I emailed them early this morning.

I was at a Go Outdoors shop buying things for the festival I have just been to and when loading my car. I stupidly shut the boot and my keys were in there. Could not access my car at all. Luckily I have RAC assistantance who took over an hour to reach me before they let me back in and I drove off. I thought I wouldn't receive a fine as well cameras would have seen the RAC surely so I am guessing it's an automated 'charge notice'.

I emailed them saying I would not be paying and gave them the ref no off my RAC customer assistance report saying they were welcome to confirm my story with them but no matter what I would not be paying and anymore letters they send me will be dismissed and classed as harrassment. Told them my key was faulty and couldn't open the doors haha! Don't want to seem stupid for locking them in the car!

Anyway so now I have stated my appeal and informed them I would not be paying should I ignore all letters and threats of court etc? As I've read these cowboys can't do anything to make me pay.

    If they do grant the appeal, good. But what's in it for them to let people off?

    If they don't grant the appeal, ignore. Or make good your threat and send both them and the car park owner the Letter Before Action for harassment.

    PS. A spare key (without any immobiliser chip) hidden under the car might be an investment for the future.
    The acquisition of wealth is no longer the driving force in my life. :)

    I suspect your 'appeal' attempt was a waste of time but yes, you are safe to ignore Highview and just play snap with their debt collector letters which will match the template pics shown in our thread 'PPC letter chains' 3rd from the top of this sub-forum.

    Thanks for the help! Didn't think about hiding a spare key really I'm normally not so clumsy but just that day I was!

    Probably thought I'm wasting my time and a friend told me to ignore it as they have no powers and if they went court they would claim losses or something and they wouldn't win hence why they give up in the end.

    Don't know if I should be worried or not but I have a reason to have even overstayed just seems like it's an automated letter - has pictures of my car and reg on it though :undecided .

    Told them I wouldn't be Paying up so they can waste their time all they want!

    It's just an automated letter, yes - just as their 'rejection of appeal' reply will be too!

    You have nothing to worry about. Your friend was spot on!

    Shall leave them too it then they can waste their time trying to con me! So glad for forums like this reveals their cowboy ways!

    If it would go to court (which it won't ) you would use the defence of locking your key in the boot, it happens like breaking down, you have I guess an rsc document proving it, there is no way a judge would find against you.

    The parking company would be mad to even consider it, they are not stupid so forget about them going there. As for the appeal it will likely be rejected our of hand. It's good you can ignore them from now on in.

    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    Now my other friend is worrying me saying they could use against me the fact I have said in my appeal email I would be ignoring their letters and not paying the fine. But I thought I would get he point across that they shouldn't bother with letters and threats! Didn't see anything wrong with that if I had a genuine reason to be stuck there.

    I told my friend I would not be and I will be ignoring their letters as they won't bother with court etc even if they threaten it.

    Makes no difference they still won't take you to court, and they can't force you to pay unless they go to court. There won't be any boys turning up at your door, it won't effect your credit rating and they can't use anything against you. They can only use the legal framework and that is it.

    Guess I'll just chuck any letters in the bin then :)
