Paypal Chargeback.

Hi guys.
First time on here for me,hope someone can help.
I will keep it short and sweet.
I am user of E-Bay for many years and have never encountered this problem before and it may help others:

I sold a shiny new PS2 to someone in London in November, the guys address wasnt confirmed with Paypal so I emailed him several times and received by email his address.
I sent the item, using a courier.he receives the item, all is well and I leave him great feedback as he paid quickly using Paypal.
I then a couple of months later receive from Paypal an email saying that the buyer was starting a chargeback against me saying that the credit card was used without his permission (which is nothing to do with me).
I got on to Paypal who said due to the nature of the case they were going to argue the case with the credit card company.
I waited for weeks only to find out tonight, that the credit card company have gone in favour of the buyer!
Meaning I have not only lost £100 (what the PS2 sold for), the PS2 plus a £7.00 charge that Paypal lumped me with.

This can not be legal, that this guy sits there with my item and money and i have nothing.

Sorry if I have gone over old ground guys, but I dont know what to do next.

Hope someone can help.

Cheers.Nigemode.

Unfortunately I don't think there is anything that you can do.

this is pretty much exactly what happened to me. In the end I was advised to report it as theft to the police which I did - you can report it online in my area. The police came round and took a statement and all the printouts I had including the proof of delivery. They went round to see him and basically told him to cough up or they would prosecute. He sent me 2/3rds of the money and promised the rest at the end of the month - it never arrived but at that point I gave up as the stress wasn't worth the final 1/3rd to me

worth reading a website called 'paypal sucks' easily found using google - it's a real eye opener and the 'this is money' website - search for paypal - this is the Daily Mail website and they are on to paypal as well

PS I also reported paypal to the FSA for not protecting me in the first place as I found put paypal have very few complaints but I didn't win the case

Did you send the item to the address stated on PayPal via a trackable method?

Your PayPal scammer has likely commit a criminal offense under Section 2 of the Fraud Act 2006 namely Fraud by false representation in obtaining your goods without payment. Contact your local Police to make a criminal complaint against the buyer. I'd also advise the buyer's credit card company that buyer may have committed perjury and insurance fraud in making a false chargeback claim.

Definitely contact your local copshop who will more than likely pass on the complaint to the local copshop near the address you posted it to who will then go knocking on the address's door.

The boring old bottom line is that to cover yourself against this kind of problem - it needs to be a confirmed address, and it needs to be trackable. If one of these doesn't apply, kiss goodbye to any help form paypal.

It probably won’t make you feel much better but you haven’t lost £100 AND the PS2.

Depending on which way you want to look at it, you have lost either the PS2 OR the £100.
  • Thank You all very much for your help.I think I will now let the Police know about it.Although I think they will be a bit busy organizing their forthcoming World tour.Ha Ha.Cheers Guys.

It's all a matter of perspective. He has had both a PS2 and £100, and they are now both gone.

However, if we're being completely pedantic, what has actually been lost is the difference between the position before the PS2 was put on eBay, and the position after the scam. In this case, total losses amount to :

    One PS2
    Postage for PS2 (I'd guess about £10)
Ebay listing and Final Value Fees (approx £10 for a £100 item)
    Paypal chargeback fee (£7).

    Total = 1 PS2 + £27
For where your treasure is, there will your heart be also ...

I had the same, got a Nintendo Wii before Christmas didn't really play much on it so sold in Jan for £320 with 1 extra game. Sent via secure tracking method, got paid and I thought that was that. Received email a few weeks ago about the chargeback apparently a guy's ebay account was hijacked and bought a load of stuff and shipped to a different address. Unfortunately I didn't check if it was a confirmed address or not through Paypal, so I lose all that cash and the Wii! Was meaning to go round to the Police and report it, but having not a chance of getting it back from Paypal, I've sort of accepted defeat in a way. I've still not paid Paypal though and got a minus account, keep getting emails regarding it, but nothing else as yet.

Feel sorry for you anyway, really put me off Ebay/Paypal as a whole.
