Car impounded for no insurance, was told by insurance company that we were insured

the police cant suspend but can confescate a persons driving lincense if they believe that is not the person(s) producing that license to them, they will take the license off the holder untill such that the officer can determin the identity of that license holder is true.
i believe what has happened here is that a person of same name and DOB, has commited several offences and have had their license revoked, this officer then went ahead with his proceedure of seizing the vehicle, and switched off to plea's of the driver. wich is arrogant in my honest opinion, as the officer was presented with a situation where by a case of possible mistaken identity was being made and he should have run more checks, contacted the insurers, he chose not to because he thought it was open and shut case.
go to the police station with utility bills and a wage slip, and then ask for that license back, and arrange for you vehicle to be collected.

The desk sgt gave permission to the cop to suspend the licence. My partner still has the actual licence but it is of no use now due to it being suspended on the dvla database.
Going down the station today to try and sort that out. The impound place isn't open until Tuesday so that will be another issue to overcome. But if he gets his licence reinstated today (or tues as the case may be due to the bank holiday) he will be able to take out another policy and drive it away himself won't he?
Will he be able to take out more insurance if he is possibly due to have points in court or will he not go to court at all seeing as when tge documents arrive in the post, we will be able to prove he had insurance at the time he was pulled over?0 -
The first thing to do it to get a copy of the certificate that was in force when he was stopped.

Are you sure about that? It goes completely against the change in the law there was several years ago that was put in place to stop people being issued a HORT1 and continuing to drive uninsured whilst in possession of it.
What you are saying used to be the case over half a decade ago.0 -

As others have said, AFAIK the Police have zero powers to suspend a licence.
Even with clear cut cases such as DD they can't suspend the licence (even temporarily until it reaches court), it requires a Beak to deal with it.0 -

The Serious Organised Crime and Police Act 2005 added sections 165A and 165B of the Road Traffic Act 1988 which give police the power to seize a motor vehicle being driven without a driving licence or insurance.
The Road Traffic Act 1988 (Retention and Disposal of Seized Motor Vehicles) Regulations 2005 as amended formally brought these powers into force on 6 July 2005.
This was done due to the massive numbers of uninsured drivers who got a HORT and then were allowed to continue on their way still uninsured which was just absurd.
You surely cannot be completely unaware of it given the massive advertising campaigns and exposure on Traffic Cop type programmes there have been?0
