Thanks for the informative reply but some of the points you have raised do need correction.
1. There has been no witch hunt or concerted effort to pursue one individual or company. In fact the reverse is true with one individual persistently coming to MSE and posting using
multiple identities to pursue an agenda designed to confuse members, especially those coming here for the first time having been on the receiving end of an unwarranted demand for payment by a PPC.
2. What evidence has the PPC in question provided to say that a contract given to a defendant in a country court case is a priviliged document? The document itself is covered bythe long standing principle of open justice, CPR 5.4C (and Practice Direction5A) and CPR 32.13, and I suspect the PPC in question is fully aware of this.
3. The recent ruling by the Upper Tier Tax Tribunal is very pertinent to the contract in question and it gave an example of how PPC's contracts are written and how they will be affected by the UTT tribunal ruling.
4. The board member being pursued by the PPC in question is not being pursued for publication of the contract but for other reasons. Your understanding that the disclosure of the document is at the heart of the court case is incorrect.

"Cowboys" cannot possibly be a problem. Insults are not libellous: you can call people whatever rude words you like, so long as you don't accuse them of something factually incorrect (of course, some insults might be illegal - but that's a different matter).
"Scam" or "scammer" I suppose could be interpreted as an allegation of fraud and so could be libellous - but only if (i) it's untrue and (ii) it is directed at a person or entity that's capable of being libelled. Just as long as we are not gagged from actually using the terms 'scam' and 'cowboys' and 'scammers' because it's a fact that 'PPC World' as a whole is exactly that, and they are! (as per Martin Lewis, quoted verbatim in my signature).
MSE Andrea once sent a pm to me a couple of years ago when a PPC had aimed a solicitor's letter in MSE's direction, suggesting that we regulars should not use the words 'cowboy' and 'scam' but I replied re why they are correct and not defamatory in my view. Never got a reply, never got told off again!
Have to also add that I am here almost every day and have never seen a witch-hunt of one PPC. Just individual threads on separate issues. Sometimes one PPC raises its head above the parapet too much (VCS court cases didn't help them) but there's no witch-hunt of one firm, we expose ALL of them!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi all,
I really need to move on and attack a different set of jobs before the day is out as this has taken a good chunk of Thursday, although I hope it's been time well spent for all concerned. Don't think I'm ignoring points from this point on, I'll try and catch up with the thread tomorrow.

Just saw this before I left.
What I'll do is leave it open until tomorrow for people to comment, then I'll catch up on the responses, make any relevant notes, offer answers where and if I can, and then lock for the ages and hopefully it's been a worthwhile exercise.

Its a discussion thread so why lock it? Its unnecessary and the statement has raised other questions that need clarification which hopefully will be forthcoming.
