And the fact that i checked my trackin information she recieved the product two days before she emailed me saying she wanted the refund, why didnt she realise it then, only two days after?
This has no bearings on your problem though - sometimes people don't open things right away or whatever.
What you need to concentrate on is trying to find out if the item has actually been sent back. Until the buyer can give confirmation of it's return, it'll be harder for them to win the case AFAIK.0 -
First i would like to apologise about the length of this post.
I recently sold a bottle of perfume. I listed the item as used. Ebay allows it to be listed as the item is in a pump spray which means that the liquid product wasn't in contact with anyone. To save time, i wrote out a basic guideline, i.e info about returns, shipping information, other bits and bobs which i use for all my listings (by the way im not a business seller, i just needed the extra money at the time). I stated in my description as the bottle is clear, usage as shown, and i have used it a few times but prefer my favourite.
But when i copied and pasted the text, i accidentally copied a part from a separate listing stating the item was new.
So the perfume goes for a very good price, im quite shocked at how high it went, but i thought that's ebay, it happens.
I send it out a little later than i usually do, but it was because a member of my non-immediate family passed away. I sent an email to all buyers apologising and i shall send the items next day first class recorded rather than second class, without any extra charge. but it was calculated to stil arrive during the expected delivery dates.
So four days later after sending, i get a very nasty email from the buyer of the perfume claiming it was used and shes disgusted as she thought it was new. i was actually at the wake of my deceased relatives funeral and was checking my phone, but i still responded via my iphone saying that i stated it was used. after i send her the email, i check my listing description and notice my typo, I know i should have read the description properly prior to submitting and i immediately email her back and said im sorry i just noticed i wasnt accurate in my description, please return the item back via the address on the back of the envelope and i shall refund once i receive the goods.
Two hours later, i check my phone and im bombarded with horrible emails stating she does not keep the packaging and i need to email her my address, then the last four are really horrible emails which claim im a scammer ad i intentionally stole her money by giving her a used product. The reception was terrible hence the delay in messaging
I apologise and said im not at a computer nor am in a situation to keep my phone on my person as im at a wake. i gave her my address and said as soon as she receives it she will receive a refund.
I come back from the wake, and she emails me and says shes sent it back by courier to ensure i get it, and she expects a full refund plus the courier charge (£34.59!!!). i said why did she send by courier when royal mail recorded delivery is what she needed to do. She said i left it too late to email her my address and she wants the refund now.
im actually quite angry about this and also a little emotional as this woman has no respect that i was at a wake. So i email her saying as a seller i wrote no refunds, and despite the fact that it was a small typo and i listed the item as used and stated several times in the description it was used, i do not need to refund her postage at all, if it was a simple recorded delivery from royal mail, even next day delivery, i would have as i have other priorities in my life, but im not going to refund something as ridiculous as £34.59 when it would have taken her no more than £4.00 to send it back to me,
Now shes opened a case. She states i purposely stole her money as i didnt send the item out when i stated, even though i emailed and apologised and explained why there was a delay, i even sent it first class so she would get it in the time i stated in my listing, and how she thinks a deceased member of my family was a ploy to gain sympathy. gain sympathy from what??? From a random person i never met??
Shes wants to claim from her bank that the transaction was fraudulent, so in the end it works out she gets the £35.00 for the perfume i sold and another £35 from claiming the transaction is fraudulent from me. so i basically lose £35.00 quid.

Listen Darling, you have done nothing wrong, its not wrong to tell a stranger your at a funeral. Its not wrong to keep your phone on you at a funeral for any reason, you are not at their funeral nor on of their dearly beloveds so i don't quite understand how all these happy people posting on your thread all seem very offended.
Personally i would have ignored the witch, she will wait until im ready, like you say people have personal lives to attend to, what if you were admitted to hospital and had just come out, shes still allowed to swear at you and give you a hard time because you should have been able to give the witches moolah back from your hospital bed? Don't be ridiculous, this is not a company, its eBay for christ sake. Funeral, Hospital, even if you got a headache, hey if your not able to post her package, or give her money straight away, tough poo!
You made a simple mistake which by the looks of things your trying to rectify. We all get crazy buyers like that, who think that the world revolves around theire transaction and their transactions alone, believe me, ive had my hand at being an eBay seller, and you come across the most horrible of people.
These fellow lubbly jubbly posters dont seem to realise that not everyone is the same, some people like to be vague as !!!! and say IM BUSY CHAT LATER BYE, while others will be truthful and state it how it is. Just because someone says im at a wake to a stranger isnt at all strange, you were being honest. So what if you told people you were at a wake, Jesus Christ its not the end of the world if she told the buyer. if you really wanted to get off with her moolah, you wouldn't have replied. Why would you say, okay ill refund the money, if you don't want to refund?
These morons have nothing better to do than see everything on the business side of things. FOR GOD SAKES BE A LITTLE SYMPATHETIC SHES LOST A MEMBER OF HER FAMILY, AND DESPITE ALL THAT, SHES STILL TRYING TO BE AN HONEST PERSON AND DO THE RIGHT THING.
I wouldn't have even refuned her postage cost to send it back to you, i would have said tough poo. Would anyone seriously go to Asda to return a damaged product and demand that Asda cover the petrol it took for them to get there, or the bus fare? NO. So why is it different for an eBay seller, even online merchants say Buyer returns product at their own expenses.
Personally i don't think shes sent it out. If you send courier, especially within the UK, 40 quid will send it almost working next day, if not 2 days. The fact that she isnt handing over the tracking is another sign that she hasnt sent it.
And shes being abusive in her comments at the Claim centre which could mean shes hoping to cause a big fuss that in the end you will just give her what she wants. Don't do that, just accept the negative, one negative doesnt really make a difference when you have all positives. And like you say, you are not a business seller so its not going to damage anything really.
i don't understand the big fuss here with everyone against the OP. The basic line is BUYER BOUGHT SOMETING AND WANTS TO RETURN THE ITE BECAUSE SHE NOT HAPPY, SELLER AGREES AND IS WATING FOR PRODUCT. Thats the basics of the story. SO HOW IS THE OP AT FAULT?!

Having the money to buy perfume is not the same as having money you can afford to have floating around in limbo until a screwup seller gets their !!!! together. Refunds can take over a week to process depending on the seller's competence - suspect in this case - and the bank. So she has to send it back, wait till the seller receives it, wait till the seller authorises refund and wait for the refund to process before this !!!!up will be undone. So why shouldn't she expedite the process a little by using a faster delivery service?
Seller should refund the perfume and courier costs and either not make such a horrific mistake again or stop using ebay. It's your own fault this happened and you should own your mistake.
So if she is in hard luck of cash, why is she even sending it via a courier?? if it takes a week for everything to be properly processed even after the seller gets it, why why WHY would you send it via courier if you are not going to get the 30 Quid you have supposedly been scammed out of, that you so desperately need straight away. And if shes so poor, why buy perfume, even if it is from ebay? Hey im having a hard time feeding myself and paying the bills, but as long as i smell nice it doesnt matter. Utter rubbish. The buyer is being as idiotic as you.
Havent you heard of Royal Mail Special Delivery? Delivers next day by 1pm. You cant get faster than that! Well apart from Weekends, but even then, Banks are the same as postage, everything is working days. So if the seller were to receive it, on the weekend, the refund wouldn't have been able to start processing until Monday, therefore, it would have been the SAME THING. But no, the supposed poor lady has money to invest in a courier service but is so desperate to get the money she spent back and then some more. I smell a scammer and its coming from the buyer. And i smell a moron and its coming from you.
Now if you have any common sense, like you say, she wants to send the OP the perfume asap to get the refund. Why hasnt the seller received it? Royal mail would have been by now if she were to send it on friday, but the supposed courier is still not here yet? And why is the Buyer being vague to the tracking information.
Ive come across people like the buyer in my time as being an eBay seller. You get people that claim that the item isnt as described, want to keep the item but get their money back and pretend that they sent it and it cost them an arm and a leg to send it back to the seller. Just to get more money and keep the product.

Put it this way. If a seller !!!!s up with me, I do a bank chargeback and email telling them they're welcome to come and pick up their item. I'm not being paid to repackage their crap and make the trip to the post office, so why should I? A refund for the cost of P&P doesn't reimburse me for the time and stress (leaving the house at all is very difficult for me. It happens maybe twice a month, in a good month). So just consider yourself lucky you got off this lightly.

eBay even agrees, the Buyer should send product back at their own expense. You are one of the morons who probably takes items back to Aldi and says its damaged, give me back my money and the money it cost for me to get here. Most online mercants state buyer sends back product for return at their own expenses. shes not sending back a priceless diamond ring, shes sending back a second hand perfume.
Neither is the OP getting paid either. If its not an eBay regulation, Seller doesn't need to do Eff all.
OP just refund the item IF it arrives and leave her whining about her supposed postage expense, You cannot claim for the same transaction twice, The bank will notice the money going back into her account therefore the transaction doesnt exist anymore and she has her precious money back. Thats all the bank will care about, if she has the same amount of money back from the supposed fraud transaction. Take the negative and just carry on being a good seller, just maybe get someone to proof read your listings prior to selling

To quote a couple of posters 'you're not the only person in the transaction with needs, wants and feelings' and 'such a horrific mistake'

Lets put this into perspective. The seller screwed up, unfortunate mistake to make, but it happened. The buyer is furious, thinking she is getting a new product she receives a used bottle of perfume.
Things go horribly wrong and a case is opened.
So, the easiest thing to do is refund her in full as soon as you receive the item back. If you don't receive it back, don't refund.
As for £40.00 courier fee's,tell her to swing for it. Its a ridiculous amount of money and you are not liable.
You will receive negative feedback. That's a given. Posters will say that is not the case, but your buyer is extremely unhappy and I doubt you will walk away from this with your feedback intact.

Her buyer is also entitled to something reasonable for their money. If more sellers treated their buyers with respect then things wouldn't happen. From what OP was saying originally, it didn't seem like they understood this.
Diplomatic and responsible treatment of buyers with issues should be reasonable to expect of sellers. It sounds like the situation has been exacerbated because of tension on both sides. As the seller OP is in the position where she needs to convince the buyer that she did not really need to pay £35 to return the item by courier. That is going to take a lot of bottle - and a lot of understanding that although the buyer has thrown dummies out of their pram too, there's a lot that the seller can actually do to solve this - and it's actually her job to.
I do think there are some rather too harsh responses - but what I wrote is common sense. It was an honest mistake. From what I can gather the OP mentioned more than once that the product was used in the listing and there was just one mention of the word "new" that got muddled up with a description.
Personally, if I saw the OP's listing I would at least send a message to ask whether the perfume was new or used. But then again maybe the listing was close to ending.
Regardless, that doesn't give the buyer the right to be unreasonable and downright rude. If there is a problem with the item, so be it. The buyer has a right to be miffed and even angry if the seller refuses to do anything about it, but the OP was perfectly happy to offer a full refund (including the return postage, if it was sent properly!).
OP, if the buyer can't provide a return tracking number then the case won't bode well for her. It may be a case of eBay refunds her the money themselves and you won't have to. I seriously doubt that she has actually sent it via courier and is just being particularly difficult in order to get some extra money from you.
Don't worry about it, try not to look at her comments on the case as from what I've gathered, it's mostly insults at your expense (although I would keep an eye on the case as you may need to provide more information). Keep the messages you receive from her as you can hand them over to eBay as well. As long as you have been honest and polite in your account of the case then eBay should be able to sort the rest out for you.

I dont understand, she first did say it was in the description, she checked her listing noticed her mistake and then apologised and said please return the item back? So how was she not respectful. And it seems like the Buyer had a chip on her shoulder from day one. Who gets that agitated over a typing mistake, The seller apologised and did everything she needed to do. What else was she meant to do reassure her and sing her a lullaby?
Sure she may have said something that she didnt need to refund her the postage costs that it costs for the buyer to send it back to her, but its not a lie, its te truth, and when the buyer signs up to ebay, she accepted these terms and conditions. Tough poo if she wants to send it via courier, not like she didnt have an alternative.
The item is still not with the OP, which im sure was never sent.
The Seller is a person as well with feelings etc. You wouldn't like it if you worked in a shop and someone returned something back along with abuse. Why is it acceptable for the Buyer to be all abusive towards the OP? Just because she made a typo mistake which she apologised for and said she will rectify once she receives the product.
