returning a used car seems very grey....

    If you want to involve VOSA (and personally I would be if the MOT may have been a paper exercise) then they really need to be the first to look at the car because, as soon as it goes near the garage (presumably the same one who issued the ticket) there's wriggle-room for "it wasn't like that at the test".

    I'm all for giving dealers a chance to sort things but (assuming the info is broadly accurate) this one doesn't seem that interested in doing so.

    More importantly, if there are genuine concerns about them using print-to-order MOTs, it's in everyone's interest to get it investigated - it's potentially dangerous and gives them a grossly unfair advantage in the market against other dealers who play it straight. the only way to get that sort of thing investigated effectively is to report it without giving warning for them to tidy up their records.

    Either way, taking delivery isn't the same as "accepting the goods" as far as SOG is concerned. The idea of a "reasonable time" to inspect/test and reject for a refund if faulty etc is part of the law

    andy.m and others. no she hasnt accepted the vehicle upon delivery in the eyes of legislation soga is an ACT that was passed in parliamant (so not law).

    i believe the OP acted fairly, she went down there and gave the guy an oppertunity to replace the vehicle (because the OP didnt accept the vehicle as it was not of sufficiant quality) and was happy in paying a little extra for one off stock.

    the guy was totally blinded by this potential extra cash, and had cotton wool in his ears when the OP tried explaining that she was not happy with her goods and wished to have it replaced because in legislation (there to protect BOTH sides from wrong doing) she was entitled to he kept refuring abruptly by interuption saying give this number a ring, now sorry HE SHOULD be giving the OP time to explain her concerns he didnt thats not entirely fair at all, and then to disrepect her and shout and swear at her on the way out like a little wimp is not on either.

    OP do not drive this car now you have every intention to reject it, record the odemeter reading with a photo, and compare it to the sales invoice odemter reading so in future come time he has it back does give him time to say you put 40k miles on it and must have used the vehicle when you said you had formally rejected it and told him to collect it so he will now take off useage in the refund.

    thought all you honest traders would be happy this dealer has been named and shamed, after all if your honest then people near this person (if your in the area) would flock to you instead or are some of you in the old school boys club with this numpty?

    praise vent and warnings is full of one side storys that people have named and shamed there pehaps you can take this issue up with those down there too.

    Why the need for large shouty red letters? If you read this thread and all of the advice people have given so far, you would understand why I am seeking independant advice before going back to a dealer, who has left me in a posistion were I feel I can not trust him.

    An official independant body I'm sure will tell me if I have been incorrect in my misgivings or un-reasonable in my requests. Given my current course of action has not only been advised by the forum members here but by citizens advice aswell I belive than I am not doing anything un-fair or incorrect at this point.

    As for naming and shaming, It's not like I've opened a thread and started naming from the start , nor have I been excessive in what I have said about this guy, despite being encouraged to at least name and shame from early on. My personal comments and opinions on this thread is a request for advice and assistance from others who may have more knowlege and experience than me, whilst blogging my progress. My comments on the dealer are my personal review of this buisness and my experience with them.

    Reviews are the customers way of giving there opinion of there experiences so other customers can make an informed choice , or at least use those opinions to be vigilant / warey.

    After reading your post I did a little search for other reviews online and found two other people with similair experiences to myself. Unfortuantly as a new user here, this site will not let me post the links, but you would only have do a quick search to see for yourself.

    I just wish I'd been savy enough to have done that search before buying my car.

    I stopped driving the car as soon as the AA got me home on monday. I will go and take a photo on the cars current mileage this evening. I've just looked back through at my recipts to see what milage he has put for the car and the dealers has not filled in any of the following details on the on my recipt:

    Basic Price (though the net balence was filled in, which was what I paid on top of my deposit, so no record other than credet card recipt & statment of having paid a deposit)
    also no details in any of the following box's Date of sale / Date of Reg / Chassis No / Engine No / Mileage / Warrenty / there is no info in the VAT box either.

    There is a milage figure written on my warrenty recipt, though I notice he has written the value of my car there as £500 more than I paid for it.

    Is this going to go agaist me in proving I've stopped using the car?

    That's something you could have mentioned before.

    Get on to your credit card company and tell them the story.

    Keep it simple.....

    Car has multiple faults discovered in the first couple of days, you rejected it under SOG but dealer won't give money back.

    Credit card companies don't like unhappy customers or merchants who don't play by the rules and leave the credit card companies open to S75 claims and will likely put pressure on dealer to get it resolved pdq.

    Any more letters you write cc to the credit card company as they are jointly liable with the dealer
