returning a used car seems very grey....

    You accept the car the moment you take delivery.

    According to what?

    You certainly don't "accept" any other goods as soon as you receive them. Your right to reject them under SOGA continues after that point.

    OK, the guy deals in leggy second hand cars and I bet you couldn't see any sign of a workshop at his emporium.
    You want your car fixed and he gives you details of where his friendly mechanic is.
    You now have the choice of ringing the mechanic, getting it sorted and moving on, or go down a pointless legal avenue where your car will still be running like a sick pig for many, many weeks before it is resolved.

    Then what do you do when you take delivery of a car?

    Not sure about pointless but if the OP is rejecting the car then they can't continue to use it and must either deliver it back to the dealer, (assuming he accepts the rejection) or, if he won't accept the car back then arrange for safe storage until the issue is resolved (with any storage charges being added to the final bill)

    Obviously an independent report on condition should be obtained before handing the car back

    I'm so seriously angry with this guy right now, it really didnt need to escallate this far at all.

    No it didn't but it is obvious that your attitude has not helped one little bit.

    All that you need to do is ring the number that you have been given and chillax, simply give them the opportunity to investigate and fix the fault.

    Did you expect him to resolve this problem on a Sunday? No you expected to get your money back!

    Much the same as you do when you buy a tin of beans or are you suggesting that you couldn't return a tin of beans because you didn't discover if was rotten until you opened it three days after you took delivery of it?

    How about a book with pages 150 to 170 being a repeat printing of pages 130-150? (as happened to my OH recently with a book she "took delivery" of last Christmas but has only just got round to reading.... the shop concerned gave her the choice of a replacement or refund)
  • Dealer sounds like a total **** to be fair, I'd be fuming if I was in your position.

    95k and a 2003 plate is hardly a banger - the newest car I've ever owned was a 2003 and had 97k on the clock when I picked it up.

    Looked after it should have double the mileage in it and another 5 years at least.

    My last car had 200k on the clock with zero faults, and for the last 100k hadn't had anything other than routine servicing.

    I'd be sending a letter to the dealer rejecting the car (via Recorded post) and giving 14 days for reply. If he doesn't, small claims court.

    No I did not expect the problem to be fixed by him, If I had I would have not have written this post and would simply have claimed on the warrenty. My issue was that I was sold a car with a dangerous fault that almost got me in an accident with in 3 days of purchase. I did not wish to keep the car, though i would have been happy to have exchanged it as i have mentioned earlier.

    As for my attitude, I didn't even get an oppertunity to have one, as the guy had no interest what so ever in hearing what my concerns were. If he had he could have made an informed decision about wether or not my concerns were unreasonable and had a conversation with me to explain his stand point and why he was talking it.

    Instead I was dismissed as soon as i said "i have concerns with the car i purchased" after that I was talked over and told that my requests were illegal.

    Im sorry but I really don't feel that my attitude is the issue here, My concerns are genuine and I don't feel that what i wanted to request as a resolution was unreasonable.

    To be honest if he had let me ask for an exchange he would have been better off right now, because given my experience i was more than happy to pay the extra for a more expensive car with less miles etc on it. but hey if he wants to be really rude and cut me off im not likly to feel enthusiatic about giving him any more money to be honest.

    Physically 'accepting' (or collecting) a car is different to being deemed to have 'accepted' the car in law. The sales of goods act allows 'reasonable' time following the sale of goods to reject for a full refund. After this you are deemed to have in law 'accepted' the goods and not necessarily entitled to a refund - but are entitled to a 'remedy'.
