Qualifying for one and having a blue badge are two different things.

As far as Disabled Bays and the Equality and Disability Act goes, it isnt.

If someone has a long term disability that affects their mobility then the car park owner should ( has to?) give them dispensation to use disabled facitilites ( such as slightly wider pakring bays etc) that is regardless of weather or not that person has a blue badge or not.

As for people deliberatly using disabled bays without the need to, and by doing so depriving those people who need to use them the use of such facilities, they are ( in my opinion) not much better than the bosses of the PPCs

hey linconshire yokel where were you!! you were meant to pick me up think i was at wrong carpark though. I have got a war pension and soon a disability pension. i worked hard and played hard serving the country blah blah during the war yarns. I could of poss got a blue badge but dont think i need it. but nice to know that if my back, knee and shoulder giving me bad jip i could use a disabled bay.
Noddy could you ask the " enforcement officers" to join up and wear a real uniform rather than the yellow school lollipop ladys outfit that they seem to have adopted (no offence lollipop people). They then might feel like they are being of real service then. :D:rotfl:the enforcement officer at tescos had a belt like the police wear around his waistfor his mobile phone, note pad, maglite torch (PMSL at that one) and doughnuts no doubt. i should of asked if he was expecting a sudden eclipse of the sun and needed to get that ticket printed what ever the condition.
The word about the scammers is spreading like marmite here in the westcountry.
We workers all love it and the ppc hate it :rotfl:

You do realise that the bluebadge scheme doesn't apply in off road parking like private car parks, don't you ? The Equalities Act most certainly does apply though as its legislation rather than unenforceable terms in a private car park

Do you really need to ask what kind of people run parking companies?

And to add to Taffy056's post the criteria for a Blue Badge excludes many disabled people and, since February 2011, excluded a sizeable number of people who up to that date qualified for one. Whilst the change of criteria did away with their blue badges it didn't wipe out their disability nor the responsibility of such places as supermarkets and retail parks to make reasonable adjustments under the the Equality Act.

The continued involvement of Disabled Motoring UK in supporting the action of PPC's and supermarkets in excluding disabled motorists is puzzling to say the least. If I was cynical I'd think that their opinion may have been bought by way of the "donations" DMUK get from PPC's.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

First of all you don't want supermarkets to have any control over their car parks so you can all park as you wish, even in disabled spaces, for any reason and then you want them to somehow provide parking spaces for people who might be disabled ..... ermm they do but you people are parked in them!

We'd like them to comply with the law. I guess you think that their trumped-up "rules" are more important, however egregiously they break the law.

You people ? Listen you are doing yourself a disservice here, we neither endorse or encourage people to abuse car parks, whether private or council. The point you are missing is that the blue badge does not operate on private land at all, the link below outlines where you can park.

The Equalties Act applies here, you can be disabled without a badge, I am considered disabled but have no badge and IMO no need to park in such a bay, but I have the right to do so nonetheless.

Oh I am so sorry for you that the PPCs find it so hard to understand the Equality Act. So sorry that disbled people who need to use these spaces can't simply be branded with an 'unclean' tattoo on their forehead or something, and a special big flashing arrow 'disabled person here' on their car. That would make it nice and easy for you lot wouldn't it?

Ain't gonna happen, the law is the law and it's TOUGH that you lot cannot tell who is disabled or not. Don't you also think it's just as difficult for employers HR Depts to suss out who among their staff are considered disabled? Yep.

BUT THEY STILL HAVE TO COMPLY WITH THE LAW AND MAKE REASONABLE ADJUSTMENTS AND CARRY OUT EQUALITY IMPACT/RISK ASSESSMENTS.

But you lot don't know what that is do you?

    http://www.equalityhumanrights.com/advice-and-guidance/service-providers-guidance/the-duty-to-make-reasonable-adjustments-to-remove-barriers-for-disabled-people/

''If, however, a disabled person can show that there were barriers you should have identified and reasonable adjustments you could have made, they can bring a claim against you in court, and you may be ordered to pay them compensation as well as make the reasonable adjustments.''
