How do I deal with this one?

3 weeks ago I won something on eBay with a delivery estimate of 4 working days. To date it hasn't arrived. I tried contacting the seller several times with no reply. When I messaged them on Monday I had an email stating they were out of office until the 15th, so yesterday, the 15th I messaged them again. No reply.

I messaged for about the 5th time this morning and requested an immediate refund. Nothing. 7pm tonight I get a dispatch notice for the item! :mad:

Seriously fuming now. I've messaged again and told them in no uncertain terms I do not want this item, I will refuse delivery at this end should they still send it, and I want my refund by tomorrow lunch time.

Now, thinking about it, they have ignored all comms and I do not know if they are sending via recorded so if I file INR tomorrow and they upload a tracking number I'm stuck.

Any suggestions?

    Open up a INR dispute now, thats all you can do. You have been very patient.

    Yes, but as I said, If I file INR and they upload a tracking number now I'm stuffed. They could be sending me an empty box at this stage for all I know and to be frank I wouldn't put it past them.

    I just want a refund but it looks like I'm now going to have to wait another bloody week for that.

    Wait and see if anything materialises. It may not even arrive, they may have just marked it as dispatched to get you off their back.

    You could, as a last resort, sell things on, given you are a seller too. I know it's not the same, and you might not get the same price for it that you paid out, but it could be the simplest way if it comes tracked.

    You might also be able to ask for a return.

    You also, presumably, have recourse to feedback.

    I'm interested in further details of this situation. (Not that I have this problem myself).

    I thought that a seller had to provide proof of delivery to avoid an INR. That a tracking number showing dispatch was given by the seller shouldn't be enough. If the OP refuses delivery, the tracking will not show as delivered, and wouldn't the buyer win INR?

    Of course one problem that might occur is the delivery company doing a phantom delivered with signature or leaving it in a so-called "safe place" and then claiming delivery.

    Good point, RH. It's obvious - once you think about it.

    Pullip, start a dispute when you want to. As long as you don't sign for anything, then you should be OK.

    BTW - sorry it's OT - I'm always intrigued when I read your name - I kind of think of tulips - but what does 'Pullip' actually mean - and why is it crying? :).

    Thanks all, you are right, as long as I don't sign for anything its all good! Not really thought of that. It's been marked dispatched, but they haven't uploaded any tracking whatsoever.

    Seller promised 4 working day delivery so I've been more than patient. It seems likely that they forgot to send and went on holiday, rather than actually acknowledge the fact that they have messed up they bang it in the post and completely ignore any communication from me. I'm livid over it, customer services at its very worst.

    A Pullip is, as gleeful says a rather expensive Japanese doll, there is one in my avatar picture. The tears part came from a flippant remark from OH many years ago about him crying tears of despair from the money I spend on them hehe.

    On hindsight, I'm not sure it's as simple as I suggest. There must have been cases before when buyers refused deliveries and then went for a refund.

    Here there was an insufficient postage case with the buyer being told that they will win INR if they don't pick up the item as the sender won't be able to prove delivery: https://forums.moneysavingexpert.com/discussion/3523009

    Here someone says that ebay advised them to open INR for a refused parcel. Again refused due to damage: https://forums.moneysavingexpert.com/discussion/3127346

    A simple search didn't reveal any past cases that were near identical to this case however. It does seem overall that refusing delivery will enable an INR dispute.

    Well, I've opened an INR dispute. In all honesty I will be surprised if they have even sent it let alone sent it tracked as shipping was free anyway.

    I've got a fab relationship with my postie so he'll let me see if there is a sender address on the packet so I can refuse delivery. If it does arrive via standard post then I'm afraid they are just going to have to send me the postage to send it back to them.

    I`m not sure, but i`m sure i`ve read somewhere that so long as attempted delivery [which can be proven via a tracking number]has been made a seller can successfully defend an inr claim.
