    That was in the back of my mind as well, I seem to recall reading that myself. We'll see how it pans out now, I should get my order or a refund. Either way they will be getting the neg of their selling careers.

    Extremely good point Buggritt! Would that make any odds to an INR case though?
    FWIW, still no response to the dispute.

    No, sellers must prove delivery to win an INR, it is buyer returns where proof of attempted delivery is sufficient.

    Well, its arrived. Untracked and posted through when I wasn't in so I couldn't refuse it.

    I've been thinking about this, its seemingly in the sellers interest now to completely ignore me isn't it? If they communicate with me in any way I can mark their stars for communication, by continuing to ignore me I can't knock those stars.

    Now, do I....

    1. Cancel dispute, keep item I dont want from them anymore and move on.
    2. Let dispute run, I will win as the item was sent untracked and then message them and tell them to forward me postage and I'll return their item. This means that to get their item back they HAVE to communicate with me.

    I've been treated so appallingly by this company I'm very tempted to go with #2 to be honest. I still cannot believe that their idea of customer service is to ignore someone for 3 weeks then dispatch their item without comment when they question where it is.
  • The failure from the seller to bother to communicate should be a very big neg, really.......I would mark them down heavily if possible on their "communication" which has been incredibly poor (nonexistent!)

    I would also be inclined to proceed with 2........... And send the item back when you have had your refund.

    If there is ANY communication, ie from you to them, or them to you or both then starts become markable. It doesn't need them to respond.

    I wonder if they are aware of that or if they perhaps think that ignoring customers will prevent them leaving a star for comms? It seems from recent feedback that most of their negs and neutrals are for lack of communication.

    Yes, but as I said, If I file INR and they upload a tracking number now I'm stuffed. They could be sending me an empty box at this stage for all I know and to be frank I wouldn't put it past them.

    I just want a refund but it looks like I'm now going to have to wait another bloody week for that.


    If they send you an empty box, do an IND and sent it straight back :)
