Well done. We have been encouraging posters for several months to try this approach.

Yours is a classic case to sue Asda because you have already told them the circumstances so they knew your passenger was disabled but they ignored it.

Please keep us posted and don't take a denial for an answer. A small claim does not need a solicitor or anything and you have made a tangible loss and it has had repercussions and caused upset and inconvenience for you since then as well.

At the very least I would expect Asda to send a massive apology, flowers and a nice voucher - but it will be your decision whether to accept it or whether to continue to sue them. They will hate this - especially any publicity about it - but it's what has been on the cards for ages, years.

Include this article attached (bear in mind the law is now called the Equality Act 2010 but the effect is the same as the old DDA quoted here):

    http://news.bbc.co.uk/1/hi/uk/8488737.stm

Tell Asda that you will ask them to explain to a judge why they have done NOTHING to avoid this issue even though you have evidence that they had this breach raised by the BBC nearly 3 years ago. It must NOT be left to a customer to complain after getting the fake PCN - there simply must not be any fake PCNs issued to disabled customers, full stop (by the way it matters not if you have a Blue Badge for your son or not, he is protected by the law anyway).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Firstly thanks again for your help ..we finally received this reply from Asda this morning.

At our Greenhithe store we use ANPR monitored system, which currently only recognises if a customer is carrying a blue badge if they're registered on our system. We are currently updating our signage across our stores, to make it clear to customers if they require additional time, we can add your registration details to our systems to make your vehicle exempt from the overstay period on that or any future visit.

To say sorry for your experience, we've refunded the PCN fee you paid and we've also attached a £50 gift card which you'll be able to spend on your next visit to any of our stores.
We've also taken the registration details of your vehicle and added these to our systems.

Thank you again for taking the time to contact us. I hope this letter helps explain our position and will go someway in restoring your faith in Asda.

If there is anything else I can help you with please let me know.

This was signed by J Bottomley Asda Executive Relations.
My OH is happy enough to accept this ..so I can now pop into asdas again ... and the voucher will help out with xmas ..
Im just glad I looked in here and got your help. :T:beer:

Brilliant stuff, and a fab result for you, well chuffed that we have had one of the major retailers admit they have got it wrong. But got right by refunding you and giving a gift card, hope they take the next step in removing the parking company from their car park
Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?

    Go treat yourself :)
    For everthing else there's mastercard.
    For clampers there's Barclaycard.
  • Well done. Just goes to show it's always worth going after the organ grinder rather than the monkey.
