Ok well i messaged her, and she said she is going to claim from RM, all good (except im not sure she knows that she is expected to wait 3 weeks) but she has said in her message that she will refund when she has heard back from royal mail, now im not sure whether to open a case, i know i should but i feel like she thinks i have the item and am just trying it on. Im happy to wait until after the weekend to see if it turns up, but i really do not want to wait until after the beginning of next month!
Open a case. You only get 45 days, so be careful. Open it in PayPal and escalate it as soon as you can, you will still have a wait for your refund.
The seller will wait an absolute age to hear back from Royal Mail and that is irrelevant with regards the transaction.0 -

Seconded or thirds (or whatever we are up to now). I rarely ever open any sort of case against a seller, but the moment they start telling me 'it isn't their problem' however nicely it is easier to let eBay/PayPal sort it out.

Well she has just emailed and said the PO have told her to make a claim 15 working days after posting, which i knew anyway, but is still stating that she will refund after she has had a refund. I will wait a couple of days (to see if the parcel does actually show a bit late) and if not i will open a case. Really didnt want to, but i also do not want to wait until she has a refund!0
