How to rate this seller...

Hi sorry ill try and keep this short,

I won a dress for my daughter, BNWT, for an amazing price and was over the moon. The seller then messaged me to say when she was packing the dress she noticed the label had got damaged and had come off, and to be fair she asked me if i would like a refund or to continue with the sale. I asked if the dress itself was damaged as if it wasnt i wouldnt mind continuing with the sale (as i wash everything i win anyway so would only remove the tags when it got here) and got a reply that the dress was fine it was just the label.

Fast forward to today, received the dress and it is lovely, but there are some very dark marks (spots) over the shoulder and the reverse of it. As the dress is white im not 100% that they will come out. Question is do i a) tell the seller, even though i asked to continue the sale b) wash the dress and hope that they come out? Im happy to keep the dress if the marks come out but im surprised the seller didnt notice when she said about the labels.

    You requesting to continue has nothing to do with this.

    I would email and tell her the situation, if you are happy to wash and see if they come out ask the seller does she agree that you can wash the dress, as unless the marks come out you will have to return the dress.

    If she gets funny just return as not as described or if really cheap I might just let it go as it could cause more hassle than it's worth.

    Most people's natural reaction would be to wash something and see if the stains come out, then get back to the seller. There is a contingent here who claim that by doing so you have 'accepted' the item and therefore should not wash it, but that's a bit pedantic; I aired a shirt that came to me stinking of smoke (in a paper envelope so not the fault of a grey mailer) and it was fine, but I'm left wondering sometimes what I would be advised to do were it still to have smelled bad.

    Before leaving feedback, always attempt to work it out. There are only a few occasions I would rate a seller without contact, and that is mostly to do with postage overcharge and delivery delay which deserve a 3 or 4 rating - not completely egregious but not deserving of 5*s or worth my time arguing it out with the seller.

    If the seller had mentioned the marks they would not have got a sale - there is no reason to worry about the previous exchange. For something like this I'd not be afraid to mention the marks and see whether you can get a return.

    Well i was thinking of washing (on a gentle wash) to see if that can get them out, i would much rather keep the dress if i can, i do love it, its just that with the marks on it i wouldnt use it. I thought i would ask here to see what others would do in the same situation, it just seemed strange that the seller was willing to tell me the tags had come off and offer the chance of a cancellation but failed to mention the marks at the same time.
    However that said if i wash it and the marks dont come out im then thinking im stuck!
    Having had a mad flurry of buying baby clothes/shoes over the last couple of weeks (as im expecting) this is the first 'problem' ive had.

    Okay, so maybe i spoke too early, i messaged another seller today to see if a bundle of clothes had been posted (paid for on 1st but no update since as to whether they were dispatched) and the seller has just replied that they posted on 3rd, all good, but if they don't arrive by tomorrow then i am to message them and they will give all POP details.
    Am i right in thinking i cannot claim from RM?

    It isn't up to you to claim. Give it another couple of days and if items still haven't arrived ask the seller for a refund. Be clear, don't be embarrassed, it is up to the seller to make the claim.

    Do give the seller a chance to get stuff to you though, I think 10-14 days from payment is long enough. If they refuse to refund then just open a full INR claim.

    Thanks soolin, i wasnt bothered the items hadnt arrived yet, i know not everyone can post next day, and i would always wait extra time to ensure a parcel is not just delayed, i only asked to see if they had posted as on ebay it isnt marked as dispatched but its been a week since payment, however sayin lg that, had the seller said no they havnt been that wouldnt bother me, its just so i know when to expect things really.
    I was just checking that i was correct in thinking that i cannot deal with RM on a claim, i just got the feeling this seller will ask me to make it if nothing shows up!

    Royal mail state 15 working days for loss of post, 10 for RMSD, you could still email the seller but it would be only fair to wait 15 working days before expecting a refund.

    I`m sorry but waiting 21 days for a refund is far too long. The sellers claim from rm is nothing to do with the buyer. 2 weeks is plenty to wait before getting a refund for inr.

    up to you but if it were me I would both wait and tell the buyer to wait.

    You can try telling the buyer to wait by all means.. Most can an will start an inr case if your not forthcoming after about 2 weeks as it looks like you may be shirking your responsabilites as a seller..
