Someone needs to toughen up here, put things back on an even keel so to speak, violence??, no of course not, get smart.

    Headline;

"Next door !!!!!phile kicks ball in my garden when my 3 year old grandkids are here"
I like the thanks button, but ,please, an I agree button.

Will the grammar and spelling police respect I do make grammatical errors, and have carp spelling, no need to remind me.;)

Always expect the unexpected:eek:and then you won't be dissapointed

Read it again - can eventually be prosecuted for refusing - so don't refuse, just delay. Say you will give all balls back every Tuesday, that's not refusing.

Eventually tells me it is only going to be after a prolonged period so if you were to give back the odd one or two every so often you would probably get away with it

In fact the advice I got from the Police was that if I kept them I could be prosecuted, but if I left them where they had landed they could do nothing as I wasn't keeping them or in fact doing anything at all.
So I did. For a month. The problem soon resolved itself.

Maybe in theory, but has anyone actually heard of the CPS taking such a case to court?

By some strange quirk of fate, large balls have started coming into my garden since I joined this thread - so far I have given them back, but does anyone know what the situation would be if my large dog takes a large bite out of them, as he is hell-bent on doing this to any footballs we give him

My view is that the owners take their chances, and have told the owners so (not kids, just over-enthusiastic adults getting a bit silly with Olympic fever) but would like to know the official line
You never know how far-reaching something good, that you may do or say today, may affect the lives of others tomorrow

Well it seems you HAVE to give them back & are liable for any damage.........Does that mean I could throw any valuable item into my neighbours garden & they must keep it safe for me until I want it back?!

Your neighbour has right on his side on this occasion.

He can trim your bush but the trimmings are legally yours, so he should give them back to you. Of course, you could return the favour and trim his bush too...;)
I think that the neighbour has to offer them to you rather than has to give them to you or can chuck them over.

I can guess,.... not many more balls would come over the garden fence ;);););)

If your neighbors insist on giving your dog toys, they can't complain when he plays with them.

If you refuse them, do they have the right to throw/lob them over?

This is all getting a bit ridiculous.

I'll sum it up from my point of view.

Get him to understand that he does not come into your garden without asking you.

If you find a ball, chuck it back over,.. if it's caused damage, and I don't think that's been touched on yet, chuck it the other way.

If the harassment persists, ie he continues to damage the fence or encourage the kids to, send him a letter. It doesn't have to be a solicitors letter.

Make it very clear he is not to enter your property without permission, and if he does legal action will be taken.
Send it by recorded post, keep the receipt and a copy of the letter.
State in the letter that a copy is lodged with your solicitor, to be honest it doesn't matter if it is, but with strengthen your actions.

Please don't do nothing, he will thing he has you and can get away with anything in future.:(
