  • If he won't sign the divorce papers, get a service processor to serve them to him, he has a couple of weeks to sign them but if he doesn't the service processor will send you paperwork which means it doesn't matter whether he refuses to sign them. You don't need a solicitor to do this x

    I believe that technically it is a breach of the DPA for them to hold incorrect information on him on their systems. I would be tempted to inform the fraud department of his bank that your ex-husband is using your address to open accounts when he has never lived there. They might just cancel all his cards on him while they sort it out :)

    Good point, touched on DPA briefly in my recent evening classes and there are 10 rules for data protection compliancy, including accuracy

    I would stress the point that he has never lived at your address so it is not simply a case of him failing to update his details, but fraudulently using an alternative address that he has never lived at.

    One point raised by OP - credit records attach to the person and not the address, so it's unlikely that this in itself should affect you.

    However, it might be worth getting your credit files from the credit reference agencies (I think there are 3) to double check that there's nothing on there which affects you incorrectly. For example, if you are shown as linked financially, file a notice of disassociation I think it's called.

    My ex has also refused to sign divorce papers. Get in touch with your solicitor again and let him know the situation. My ex is being served the divorce papers by baillifs. Its the best thing to do if your ex isnt coperating. x

    So why are you taking the time to return to debit cards etc to the bank? This man is fraudulently using your address so if he is stupid enough to have a new debit card sent to you why would you want to make life simple by returning it? Id chuck it in a pile to be 'recycled' when you have a minute.....:rotfl::rotfl:

    Once mail is correctly delivered by Royal Mail to the address there is no impetus on you to deal with it (not like its mistakenly for next door).

    Seriously though, I would contact your banks fraud department, explain the situation and follow it up in writing (ask them for the correct address), recorded delivery.

    Just a thought if your ex is being funny with credit cards and stuff, you should legally disassociate yourself from him, if you havent already.

    do you know the name of his solicitor? The people we bought our house off were up to their eyes in debt, I got sick of the letters, and the baliffs knocking on the door and was told by a friend that a solicitor would charge them for any mail they had to forward, so I used to send everything to their solicitor.

    I get the control thing - but I dont get why hes doing this - because if hes not getting any of his cards how on earth is he doing any banking?

    Anyway I agree with the above about calling the fraud line, and tell them someone who does not live with you is having their banking stuff delivered there and using your address.

    Judging by his behaviour over the house sale, this is just more of the same. I suspect a stupid (and pointless) attempt to trash your credit history at best, or just more control freakery.

    As others have said, report him for fraudulently using your address.
