ukpc parking ticket

hi all,
i received a ticket from ukpc in a retail park for taking up 2 spaces,i saw the 2 wardens and after much bickering they just said to appeal it,so foolishly i wrote them a letter explaining why i parked like that.(why didnt i read this forum first:mad:) after 10 days iv heard nothing, the only trouble is ive admitted to being the driver and they have my address and phone number,DOH!
so does this mean they can pursue this to court proceedings and they would have a case,

any advice really appreciated

    No.

There's umpteen other legal hurdles they have to clear (which technically they can't), the 'knowing who the driver is' hurdle is relatively immaterial.

They have to clear the 'Contractual Penalty' and 'Land Ownership Rights' hurdle, which they can't.

So ignore them from now on.

Unless they actually own the land then they dont have a leg to stand on....that is the law as it stands at the moment.

What you have is what we call an invoice, there are no legal grounds in which they can take you to court as has been recently proven in court where a Judge actually said the parking company has to be the land owner to pursue any ticket they issue.

Being as you were parked on a retail park that immediately rules them out as the land owner, if they do take you to court - which they may ! then come back here and contact Alexisv, he is the mutts nuts at writing defences, they always drop the case once a proper defence has been submitted.

Have a read of the letters page at the top of this forum and read all the ukpc letters, that way you'll know what to expect when it lands on your doormat.

Until you get court papers then you can completely ignore them, btw i'm not saying they will take you to court, they do chance it once in a while but not very often.

You would be the first if they did. UKPC don't do court unless they are in the dock!

thanks for the reassurance and advice/info everyone, fingers crossed im not one of the unfortunate few they go all the way with,im not the luckiest of people, ill sit back and wait for the junk mail.ill have a look at expected letters ill recieve and update as i get them.

so do all these private parking enforcement companys exist just because of the fear they put on people but dont have any legal rights to do it.how are these companys even allowed to trade.

They exist because there is no legislation covering this, they operate in a very grey area and routinely break the law, the problem is the police treat it as a civil problem and normally will not get involved. It's unfortunate that they exist at all, they are solution to made up problem that they create themselves.

The only people that get victimised are the clients of the businesses they say they protect, it's the same when management agents bring them in to protect flats, they have a field day in underground car parks that only residents can access. Basically it's all a scam.

that is very true taffy they are a solution to a problem that doesnt really exist, there are no real parking problems in a retail park to justify a team of wardens.someone else must profit from this though other than the parking companys,ie the shops on the retail park or the land owner must get some kind of backhander.

No the winners are the parking companies, they issue these invoices en masse and a percentage coughs up, the retailers and land owners probably get a small cut out of it. The thing is that they are supposed only claim for their losses only, so if they are the losses how do they make money ?

The answer of course it's not their loss at all, it's virtually all profit, they are just despuctable scum bags who scam motorists. If I save one person the expense of paying these often illegal acting companies I consider that job done and my good deed for the day :)

Hello everyone, just received a ticket from UKPC as two of my wheels were in a hatched area by about a foot, in a private shopping area car park. What the hatched area is for I don't know but it's on the end of the bays.
Obviously furious I was only in M&S for two minutes.
My wife is actually the owner of the car so will get any correspondence and I don't want to get her stressed about it, but really want to stick this out as it is such a petty thing.
So as I read it and sorry to go over things already covered, we should basically ignore anything that comes through the post?
It does make threats on the ticket about debt recovery agencies being involved which is a scary tactic.
