What you have is what we call an invoice, there are no legal grounds in which they can take you to court as has been recently proven in court where a Judge actually said the parking company has to be the land owner to pursue any ticket they issue.
That is not actually what the court said. What the court said is that any charges collected by the PPC were collected as agent for the landowner, because the PPC itself was not capable of making an offer to park and hence not capable of entering into a contract with the motorist. That doesn't say that they can't collect charges, it merely says that they collect them on the landowner's behalf. The court then concluded that if the PPC retained any fees and charges it collected, they were in the nature of payment from the landowner to the PPC, and hence subject to VAT.
Sound like bad news i.e. the PPC can still collect charges, but only as the landowner's agent.
Not sure it is bad news, though. If only the landowner can make an offer of contract, then surely the landowner needs to identify themselves? How can you make an offer of contract if the prospective acceptor doesn't even know who you are? And how many of the PPC's precious signs actually say that the contract is between XYZ (the landowner) and the driver? Answer: not one of them!
And if the PPC is merely the landowner's agent, then surely the PPC cannot bring an action for breach of contract in it's own name? Surely any such action can only be brought in the name of the landowner?
Any landowner looking at getting dragged into that potential legal minefield is probably going to ask itself, why bother? What's the point in retaining a PPC if it can't insulate the landowner from all the hassle and legal consequences of making an offer to park, and chasing up damages for any alleged breach of contract?
So although the court ruling doesn't expressly bar PPC's from collecting parking charges, it does change the legal model so drastically that, when landowners cotton on to what's happened, the PPC industry may be dead.Je suis Charlie.0 -
fisherjim you are at the same point as i am,i too was a little worried and was thinking about paying the ridiculous invoice just to avoid all the hassle of baliffs and court action but after reading on here i think the likelyhood seems very slim.its been 2 weeks now so im expecting the increase invoice of 90 pounds anytime now,they can go whistle for it!
let us know how you get on,just dont pay it!0 -

The more I think about it the more wound up I get.
The scam yellow envelope, the scam copy of a parking ticket, the scam employee in his silly uniform etc.
What did I do? Park slightly over a line in a 1/4 full private car park while getting some bread, I ask you!
If it wasn't so annoying it would be laughable that a company can set it self up to just send out an invoice for what ever they like, and you are supposed to just cow down and pay up.0 -

You have understood the scam exactly. That's what brings us regulars here!
Now all you need to do is bookmark the letter-chains thread, second from the top of this board, and then compare each threatogram to the pictures there. Play a nice game of 'PPC snap'.
And once you have collected & ignored a couple of the threatograms why not send copies of them to the CEO of the retailer (or Store Manager if a smaller local shop) with a complaint letter to explain why he has now lost your custom.
Most retailers would not be aware about the debt collector threats nor that it's a fake PCN, a scam played out by a company whose agenda is purely money, not parking management. They buy the spiel from the parking company hook, line and sinker and unless customers tell them, they won't know the truth = that their agent is driving customers away, cannot fine anyone lawfully and uses debt collector threats against his customers.
NEWSFLASH TO RETAILERS!!
Protection rackets against customers in car parks are not good customer service.

I was discussing this with my wife, I suggested we put up a sign on our drive stating "No Turning in this drive or a TCN for £60 will be issued" which is just about as ridiculous!0 -

So many people turn in my drive I was thinking of hiring an old fella with a ticket machine and a leather money pouch, kinda like an old-fashioned bus conductor, to charge them 20p each time!Je suis Charlie.0 -

It's worse than that:
Court Proceedings Ltd don't have a Consumer Credit Licence but act as a debt collector in the chain (a member here has reported them to the OFT I think).
And Court Proceedings Ltd are connected to the original parking company I seem to recall, a trading name of theirs. But that's not made clear on the letters which is again against OFT debt collector guidelines...
We have also tried reporting their company name for misleading use of the words 'Court Proceedings' but apparently that wasn't a breach...!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
