hi guys
i know the general rule is ignore,
but what if i have already wrote to them, i wrote to say it wasnt clearly signed, i drove in, along a wall & then down during this didnt pass one sign to advise that it was a pay & display asda, theyve rejected my appeal & sent me a standard reply with a photo of a sign!
(ive got plenty of photos of my entry & exit showing no signs) should i write back???????????0 -

If you like. Just don't expect a different reply. What’s in it for them to let anyone off?
However, even if you’ve written and told them who the driver was, it just means that they can now harass the driver instead of harassing the registered keeper.
But, they can't actually do anything, for the same reason that a blackmailer can't take anyone who didn’t pay them to court.
Continue to ignore everything you get from the PPC and their aliases. It does seem odd to deal with something like this by ignoring it. Eventually, they will run out of empty threats and stop throwing good money after bad.

Oh well, hopefully they'll be as confused as I was and they won't notice it either! If not then it's no big deal, the message is essentially the same.

Well there's still no reply from young Mr. Clarke, but I got a standard, 'your appeal is being considered' letter from NCP.
I fully expect them to deny the appeal.
No here's something interesting to consider - I sent Andy Clarke a postal order for £1.10. If I don't get that back then as far as I'm concerned he has accepted that payment. Now, most people would send a cheque, but I didn't have a chequebook, so I had to get a postal order.
If they carry on sending me letters after denying the appeal I will write them a very cocky letter telling them that I've already sorted it out with ASDA and that they're out of luck. I will also outline the basic demand that they stop sending me letter or it will be constituted as harassment. If they ignore this I will take them to court.
If that works out then there'll be one more gun in the arsenal for everyone who gets one of these tickets - send a postal order and hope they don't send it back!!0 -
Take ASDA to court as well as the PPC (if it gets that far), as they are liable as principal in a principal/agent relationship for the actions (i.e. harassment) of the PPC!

I just received a letter from Andy Clarke's office. From a Nichola Basset.
Dear Merryck,
Thank you for your letter to Andy Clarke about your recent visit to our Folkestone store. As part of Andy's team I'm available to respond to any customer issues on his behalf.
I'm sorry you're unhappy with the Parking Charge Notice you received on your visit. I can imagine how frustrating this must have been for you. We want our customers to have a pleasant shopping experience, so it's disappointing this hasn't been the case.
The conditions have been placed on the car park by the owners of the car park, NCP. I understand that you were using the store, which is fantastic, however these restrictions are in place to make sure customers get a fair chance to park in our car parks to do their shopping, and to prevent people parking in these space that are not shopping with us and are going elsewhere. We want our customers to have as much chance of parking to shop with us as possible and it's important that people aren't preventing other customers from parking in our car parks.
Unfortunately we have no control over the appeals made to NCP and would be unable to cancel you[r] notice for you. NCP will be able to fully respond to all the point in your letter.
Thanks again for getting in touch. If I can assist you any further with this, please let me know.

Right, so what does everyone think? In the letter she says that NCP own the car park. Could that be the case? She later refers to it twice as 'our' car park.
It's nice to notice that my postal order hasn't been returned to me. I'm thinking of writing back just letting them know that as it wasn't returned I'll consider it the end of the matter.
Or maybe just ignoring everything she said and saying "Thankyou for accepting my payment, I consider this the end of the matter. There will be no need for any further correspondence."
I'm going to have to chat with a legal professional about this and see how strong my position really is RE the postal order.
Still no further reply from NCP regarding my appeal, shame really, I think it's been more than 14 days.
Not following their own appeals procedure, not like these people to break the rules!0
