    RE: Reference number: P*********2

    To Whom It May Concern,

I am writing to you regarding your letter of 26th of July, sent to my fiancee, Miss *************. It appears to me the you are asking her to pay a charge of £100.00 as her car was parked in a car park that you administer.

I enclose a copy of the ticket that was attached to the car on the day in question. You will notice that the time of issue was 11:16 and that the car was first seen at 13:00. I'm sure you're as aware as I am that this isn't possible and that your attendant must clearly have been mistaken.

All users of the car work a 9-5 job and would have been working that day. None of our lunch breaks coincide with the alleged issue time of 11:16, so it wouldn't have been possible for the car to have been there.

I would like to point out that any contract made would be between you and the driver of the vehicle when it was parked there. I can assure you that Miss *********** was not the driver of the vehicle and would therefore request that you cease sending letters demanding payment immediately. Any more 'Final Reminder' letters will be regarded as harassment and will be dealt with as such.

I look forward to your reply confirming that this will be the end of the matter.

    Yours Sincerely,

    Dear Merryck,

Thank you for your letter. We have investigated the matter, and can confirm that the ticket was issued correctly, in accordance with the signage in the car park. NCP is a member of the British Parking Association's Approved Operator Scheme, and all of our signs and correspondence conform to the BPA's Code of Practice.

Your appeal has, therefore, been unsuccessful on this occasion, and we now demand immediate payment of the £100 parking charge or we'll come round to your house with baseball bats and smash your kneecaps.

    Yours sincerely

Yep, don't send that merryck, as they will just reject it as per bargepole's post!

What about this for a 'put up or shut up' letter:

    http://forums.pepipoo.com/index.php?showtopic=68969

Or this is a simpler version which pepipoo posters have used before:

"I do not acknowledge any debt to your company. Under no circumstances will I make a payment in the absence of a court judgment, nor will I enter into any further communication or discussion. Please apply to the court within 10 days or do not contact me again. Any further contact from you or your agents, in the absence of a Small Claim, will be treated as harassment which is a criminal offence as I am sure you are aware."

...or carry on ignoring them which is what I do. It's only NCP!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

As mentioned above, you could write to NCP nominating yourself as the driver in order to get them off the back of the hapless RK. Otherwise what you propose to write would seem to be futile.

Really the only letter you should write is this one (it doesn't actually matter whether Asda own the car park or directly engaged NCP, the point will be made anyway):

    Mr Andy Clarke
    Chief Executive Officer
    Asda House
    South Bank
    Great Wilson Street
    LEEDS
    LS11 5AD

    Dear Sir,

On <insert date> I parked at your <insert town> branch to do some shopping. Unfortunately I did not realise this was a pay-and display car park and I was issued with a so-called "Parking Charge Notice" for <insert sum> by NCP.

It was not my intention to avoid paying and I therefore enclose a cheque payable to Asda in the sum of <the correct parking fee>. You may wish to donate this to <insert name of charity>, but that of course is up to you.

I have ignored the so-called "Parking Charge Notice", since not only do I consider the "charge" to be grossly disproportionate, but I also understand that, in law, these private "Parking Charge Notices" are not worth the paper they are written on.

However, NCP are now harassing the registered keeper of the car (not me) for payment of their ludicrous "charge".

I am writing to you to express my anger and disappointment that Asda, through NCP, would treat a paying customer of your supermarkets so badly, and to inform you that neither I nor any member of my family will ever shop at any Asda again until you remove NCP from your car parks and cease having these preposterous charges issued on your behalf.

    Yours etc. etc.

The intention is to set up a line of communication between me and them, stopping them from writing to my fiancees address and getting them to write to me, whereupon I can begin filing their letters in my really important filing cabinet for things that are really important and serious.

The bin. I'll put them all in the bin.

The aim isn't to appeal but to get them to write to me instead. However, I will try writing to the CEO instead. I like that idea. Is that known to work or will he tell me to shove it?

He will probably tell you that it's a matter for NCP. The point is to get a bit of a campaign going to put an end to these practices; one letter will not do it, but if enough people write he will get the message.

If you are anything like me you will get hold of it like a dog gnawing a bone and if he fobs you off you just write again telling him that his response is not acceptable. And again. And again...

To get NCP to write to you instead of the RK just tell them you were the driver and invite them to do their worst. All the pleading about times and so forth is a waste of ink.

And telling them I'm the driver won't give them extra ammunition?

I'll write telling htem I'm the driver and send them that lovely 'come at me' letter Coupon-Mad linked to.

I will also send the CEO a letter because I'm at work and the ink is free!

Ammunition maybe, but, since the VCS vs. HMRC (Appeal) UTT ruling, the PPCs no longer have the gun. And, even when they did, it was a replica one.

The plan is to make them write to you. If you are going to bait a hook, use the juiciest worm you have.
