You need to send the letter saying you will be taking the bank to court now AND in this letter you put the name of your local court or leave that bit out if you don't know the actual name.
Then you need to read Martin's article and the Reclaim Help Thread which is linked in my signature for your next move IF you don't get a suitable answer from the LBA.0 -
Hi I'm a newbie and have been searching for exactly the same question however....
My local branch of LloydsTSB, is in Birmingham - England where the claim limit is higher at £5000, but I live in Glasgow (for the past 10 years)- Scotland where the limit is only £750.
My charges amount up to £1800, so can I claim through the courts in england where my bank account was opened over 19 years ago and do it in one go, or do I really have to claim in Scotland where I will have to split my claim into smaller chunks?

You claim in the country you live so you need to claim through the Scottish court system. Have a read of the Reclaiming In Scotland thread, its linked in the Reclaim Help Thread which is in my signature.
However due to the amount you are claiming once or if you get to that stage you will probably be better going through the FO, you'll find details in the Reclaiming in Scotland thread.0 -

In stage four Threatening legal action does anyone know what should be put in as the court name (Template letter ) as I have not yet got that far yet.0

Leave out that particular bit or put in the name of your local court.0

I'm at the stage were my next step is to threaten court action. With this in mind I thought I'd take a look at the template and have become a bit confused or thick, not sure which.:huh:
Anyways, in the template it says:
This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the ____________________Court will rule in my favour.
Do I put my local magistrates court in that gap or do I put MCOL in there or what do I put OR am I barking up the wrong tree

i removed the gap and just left it as the courts will rule in my favour... it worked for us first direct paid up in a week!
