    You don't accept a replacement. It is not relevant. A case will give a refund or nothing.

    Open the case in PayPal as I have said. Please be careful to watch for the divert....don't let it do it.

    Upload a photo of the tear, etc.

    Escalate it, I think you need to wait a hour or so.

    Send it back when Paypal tell you, via Special Delivery.

    Don't deviate from the instructions, don't skimp on post.

    If you need any clarification, come back here first.

    The listing is clearly misleading, but get the refund then take it up with eBay, be patient, your friend will get their money back if they do as advised.

    The seller has only three feedbacks for selling. Nothing of any great value and the last being a neg. Perhaps they will claim their account was hijacked, either way, the OP, in this case, should fight fire with fire.

    When you have sent it back there is a good possibility that the seller will refuse to accept it from the postie.
    Don't worry if this happens, as all you should have to do is to enter the tracking details into the dispute and as long as delivery or attempted delivery is shown, paypal should authorise the refund.

    As a couple of others have stated, only used Special delivery for the return.
    Recorded delivery will cost you a few £s less, but getting a signature on delivery can be a bit hit and miss with this service.

    Looking at the description for the "ipad", you shouldn't have too much of a problem with a dispute.

    Yes, it's a total scam. You should be fine though is you do what is stated above. In the mean time the police may/may not be interested

    You could say Not as Described and claim that you expected the picture to be exactly like the one shown (i.e. a hand holding an ipad) and it was not. ;)

    It also doesn't say "picture" in the title, it says "pic" which could mean anything. Could mean "provided in case" for all you know.
    So even if they reckon they've been "honest" (what a larf!) they have still misled with the title and made a deliberate attempt to mislead in the description. Makes no odds what category it was listed in; loads of people list things in the wrong categories and that's simply for sorting/searching not as indication of what the item is.

    As the seller started the auction at £125, it was clearly intended to deceive. And on a one-day auction. And £5.20 for delivery.

    The actual iPad in the the photo does not come with the item, you are bidding on a picture

    so maybe read what you're buying, I'm not saying it's acceptable to sell a picture this way but it could have instead of saying it was a picture it could have said it was damaged and only suitable for a paper weight.

    Luckily this would not really count - there would be enough evidence of deliberate deception rather than simply someone saying "tough luck". Consumer law thankfully no longer works this way, although SNAD disputes may be tricky.

    Yes, people should use common sense, but the real villain is the scammer, not the victim.

    I think Trading Standards might also be interested - a quick call to Consumer Direct should help investigate them.
