Oh dear, a friend of mine bid on an iPad on eBay.
Turns out that the seller was selling a picture of an iPad!
Now we've read the description clearly, embedded within all the details of an iPad, it does state that it is a picture, and says "pic" in the title.
It's listed under Everything else > other.
Is there any chance she can get her money back or is it a case of she should have read it properly?

This is an old scam. It is fraud (a criminal offence)
Demand your money back and report the seller to ebay. Consider reporting them to the police.
It sounds like the seller wanted people to think they were buying an IPAD - who would want to buy a picture of one??
If they are not fraudsters, and somehow genuinely believed people might want a photo of an IPAD (?) they would make sure it was crystal clear (eg big letters) what they were selling rather than relying on the fine print.
Keep ebay clean - shop a scammer!0 -
Was it sent recorded/special and has she admitted she recieved it ? If not I would claim non-reciept that way the buyer without tracking info will have to refund0

We contacted the seller who told us it was legal due to the fact it was in the description and says "pic" in the title. He said it was our fault we didn't read it properly and all the information is thereStarting debt: 3399.39 / Debt now: 2975.39VSP Challenge 2012: £39.58/£100 Crazy Clothes Challenge 2012: £3.00/£150

How much did you pay for the 'item'? Just out of curiosity?0

I wouldn't advocate this ordinarily....
Open a SNAD case in Paypal - do not let it divert you back to eBay.
Say the item is not as described, you may have to fib, perhaps the pic isnt as clear, big, bright........
When they ask you to send it back, you must send it Special delivery (don't skimp as recorded may not track).
Upload the tracking and your friend will eventually get their money back.
Be brief in the dispute and don't make mention of any fraudulent wrongdoings by the seller.
Once it is all done and dusted, report the seller to eBay.0 -
Put a tear in it and open a SNAD case, these people don't deserve anything else. Ebay will ask you to send it back, make sure you use special delivery and you will be refunded.0
