Argument with JCP Advisor over ESA

I just got back from this morning for my first WFI ESA WRAG interview at the JCP with the advisor and end up massive argument because I told him that I ain't ready fit for work and told him that I am going on holiday on Monday 27th Aug with my family to Florida for 2 weeks and won't be back until September 10th. But, the JCP advisor say my next WFI will be on the September 7th but I told him I cannot attend that date and ask him can't they moved the date to September 15th to 17th. He say NO, and say I must attend WRAG WFI or I will lose ESA WRAG and put me on sanctions. I say to him and explain to him that my family already booked ages ago and I will lose all the holiday money. He say I am sorry but you are NOT suppose to go on holiday in abroad as you are suppose to undertake work programme to help you to get back into work with the right help. So, I told him well, I am going on holiday anyway as this is not a bloody JSA before the two security mens threw me out of JCP.
Now I am really worried that my ESA could be sanctions now after massive argument because I am furious that I know the rules that ESA allow to go on holiday but not JSA thought. Really so ANGRY.

I thought WRAG WFI is only once a month ? And also the Tribnal hearing told me WRAG mean I don't have to be ready or fit for work as long it take me. Really so ANGRY and really annoyed with JCP advisor as he had bad attiude against me!0

So you still want the taxpayers to support you while you go on a holiday to Florida..........and some of us still wonder why people complain about benefit reforms........
That's up to me as my doctor say I am not ready for work as I already sent off sick note say unfit for work for another 3 months. But DWP told me I still have to attend JCP WFI at anytime and my WRAG is only short period limit for return to work after tribnal victory. DWP also say we don't need your doctor fit notes anymore.0 -
Leaving all prejudice aside, is your Doctor aware of your holiday plans and has your Doctor also declared you fit to fly?. You are quite right, your medical problems are your own business and nobody elses, however suffice to say that some medical conditions do exist which will prevent flying or at least carry strong advisories against doing so, and other conditions (broken or damaged limbs, back etc) may require medium term rest, which again, flying and touring another country is not commensurate with.
I thought i'd ask the question, as working isn't the only thing which Doctors may advise against, and this advise isn't automatically included in a 'fit note' so its as well to actually ask the question. As I understand it, the sanction would be at most for the work-related activity component, until you attend a new WFI.
Perhaps ask if there is any other date that is available?
I understand that it's usual to only sanction for half the WRAC for the first offense - so that is something to bear in mind too.
Also - there is the possibility that a tribunal would accept that this was 'good cause'.
Especially if you ask about _any_ other date surrounding your holiday.0 -
i agree with above tbh, why should we support your hollidays? IMO if your not fit to work your not fit to go swanning off to florida for 2 weeks.
but i may be missing something, but you say you go on holliday on monday for 2 weeks, monday being the 30th of july, 2 weeks from then is 13th of august.... so how does that translate to not being back until september 14th??? i know some flights are delayed, but thats taking the p1ss.0 -
It now been sorted out, I had contact DWP and advise of the holiday was already pre-booked and the tribnal aware of it too and my doctor too. They had now cancel my WFI interview on 7th September and push it forward to 28th September and they checked on my ESA WRAG and say I was on WRAG for disability reason and the JCP Advisor was given me wrong information and DWP say that I am entitled to 2 weeks holiday a year on WRAG even in UK or Abroad. And they say my ESA isn't on sanctions either. As I did attend first WFI and it only asked me if I am ready for work which I told them No, I ain't ready and they accepted it and apology for JCP advisor is in the wrong and I am glad it all sorted out. And now I can go on holiday on Monday.
I am glad I had the rights to say I ain't ready for work yet. No ones isn't force me to do so. Bloody JCP staff to be sacked for refuse me holiday.0 -
but again, how do you stretch 2 weeks, form monday, to mid september?0

I am flying out Monday 27th August from London Heathrow and coming back Monday 10th September. Going to Florida USA with my family.0

i get it now.........appart from one thing, there ISNT a monday the 30th of august, not this year anyway...0
